I will probably have nothing against IMBRA once it's not setting anyone back anymore.

My only grudge with IMBRA was the fact they didn't prepare ahead and let it hit us down hard.

But how that has anything to do with an American woman petitioning for her fiance who she did not meet through a marriage broker, I have yet to figure out . . .

and if it helps in stopping even one USC that has any sexual convictions relating to minors from getting his hands on any child of an unsuspecting beneficiary then that will also be a good thing. IMBRA has so many components, not just what we here in VJ are perceiving it as.

I have no problem with this law as many others would feel the same I believe. It is just insane the way they went about this. It's a shame, honest tax paying citizens are now basically "guilty until proven innocent". I guess I wouldn't have been upset if they wouldn't have recalled our cases, but the fact is, they approved our cases AFTER the law was in affect, yet, just now we are being told about this and having our cases reopened.

Is anyone out there thinking about a class action suit? I would be willing to sign up in a heart beat, even just to draw some more attention to our immigration process.

I should have gone with my gut and had my fiance return this summer on a J1 student visa before she graduated, and married her after a few months. Would have solved a lot of problems. Friends of mine did this last year, because they didn't want to go through this K1 process. Everything is fine for them. I tried to be responsible and do everything the legal way, and this is how my country repays me for that...

(3) How do you get around the fact that Congress can pretty much do whatever it wants with regard to immigration matters, i.e. they can completely do away with immigration altogether, or open the borders, or something inbetween (like eliminating all family-based immigration)?

Just frustrated like the rest of us I guess. I am sure their are savvy lawers around that could come up with something, but ultimatly your probably right. Congress can do whatever they want. I guess we all have to accept that it is the price we pay for living in this country. It is sad that so many people are living in the country illegally (with millions more coming every year), while many (millions and millions) less people try to do things legally and get screwd in the a** over and over.

Do you realize that the IMBRA law was enacted to protect USCs from immigrants who might abuse and/or misuse the Violence Against Women Act and prevent immigration marriage fraud more than anything?

Hell, even you considered circumventing our immigration laws by having your fiance return on a J1 Visa to marry her!

For all its worth, the Violence Against Women act and IMBRA have many great intentions and and we are much better off with them then without them.

However, it is not worth debating the 'ins and outs' and the 'good and the bad' here because for whatever reason, it is a very polarizing issue here. People tend to not read your message, and just see you as good or bad depending on what side you are arguing. I recieved some interesting emails from some wacko's here for arguing the bad points of the law, even though I am for it in the end.

Anyway, my suggestion is to leave this one alone as far as debate goes and just use this site for immigration questions, period.

I completely agree with and support the new law; for BOTH parties in the immigration process, it can only be a good thing!

For us caught in the "transition timeframe" it stinks right now because of the delays AND because they have not seen fit to tell anyone ####### is going on/will be going on. We are relying on heresay and rumours! That's ridiculous, we deserve some notification. The "official statement" they released ( a couple of weeks ago) was obvious BS. No RFEs have come out of CSC yet ( but in their statement they said " immediatly").

I have serious issues with the inefficent, disorganized implementation! Hell, I believe that some pokey "Banana Republic" somewhere could have handled this transition than USCIS/the govt/INS or whomever is responsible for this mammoth clusterfluff.

We paid the same $170 as everone else-why are CSC (TSC/NSC) petitions/RFEs not moving like VSC? Does anyone have a reason for that?!!!!

I cannot imagine anything more terrifying than leaving my family/home/friends/language/culture to move to a new country to marry someone whom I had only met a couple of times ( basically straight after getting to the USA -90 days-) only to find out he is a past sex offender/criminal whatever. Can you imagine how horrific that would be? Especially if the beneficiary is not aware of his/her rights. And of course there is the flip side. USC petitioners do need some sort of protection from fraudsters too!
