I just had a thought... my hubby will be living with me in the US on his K-3 visa when we travel to Montreal for his CR-1 interview.

Will he get his passport back from the consulate while we are there so that he can come back to the US with me? Or is he going to have to stay in Canada until the Express Post envelope gets mailed to him in Canada?

Is is possible to get his passport stamped... return to US and they mail the greencard/envelope to him in the US?

Ok, I understand that part, but they will take his passport with his K-3 visa in it when he interviews in Montreal for the CR-1, correct? Then he can't return to the US until he has that back from the consulate. Can he wait for it to be processed or does it have to be mailed???

Firstly, be sure you bring en Xpresspost envelope! A few people interviewing from Montreal have been able to get their visa placed in their passport at the interview, however there are no guarantees. I would explain your situation, how you came to the interview from the US and plan on returning that day and ask that they issue it that day. I'm fairly certain they would do it for this reason. The few people that have asked, have been for situations like this...traveling immediately, and they have been accommodated.

We just emailed the Montreal consulate about something else and received their autoreply FAQ. On it there is an answer to your question:

Q11: Can I pick up the visa the same day?

A: Because of the administrative processing associated with visa issuance, it is extremely difficult to issue visas on the same day of the interview. Instead, most visas, along with the necessary supporting documents, are mailed back to applicants within one week of visa approval, using the 12" x 15" Canada Post Xpresspost envelope supplied by the visa applicant. These envelopes must be mailed to a Canadian address. If you are already a lawful resident of the United States (on a valid work visa, for example), the visa can be picked up the next business day, at noon.

So does the K-3 make him a "lawful resident"? I would say yes, but just making sure.

He's been living with you since his K-3 visa issuance in January? Is he working? I'd say yes...

When emailing them, remember to put your case number on the subject line, and put urgent. It may take several days but you should get a specific answer to your question.

Thank you Carla for taking the time to respond to my posts! I love that people here are so helpful to one another!

He is interviewing for K-3 in Vancouver on May 19, then using his K-3 to move to the US with me on June 5 (no EAD yet)... I would immagine his Montreal CR-1 interview will be around July or August. Can I email the Montreal consulate to ask this question before our file is even there yet? It's still at NVC right now.

Thanks!
