What is the fastest you can start working K1 visa

Hi everyone,

I've been reading different threads about people who filed for employment authorization.

My question is, what is the FASTEST that one can start working?

And what is the best way to have it done as fast as possible?

And can you file anywhere in the States or does it have to be where your fiance resides...?

You can go via JFK as your POE and hope to get the temp stamp there, but that lasts 90 days only and you may not have the permanent docs by then.

Alternatively, get married first, then file for a visa and go for the CR-1 spousal visa, which results in a green card imediately upon entering the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The key to the employment "question" is will an employer accept the temp stamp if you can get the stamp? And would an employer be willing to hire a person with a short expiration date?

From what the gurus have posted here a few months back, the verification employers have to fill out now (starting Mar 1?, April 1?) to employ you has changed. It in effect makes the JFK stamp no longer useful as a means to be authorized to work.

Quickest way to work in my opinion:

  • Get all your immunizations in home country and recorded on a DS3025 so no delay getting shots in US.
  • Save up $1010 for filing AOS.
  • Fill out all AOS, EAD, AP paperwork where possible before you enter the country and get it organized. (It's alot of stuff so start early)
  • Enter US
  • Get marriage license the next day.
  • Marry asap and get license signed by officiant.
  • Walk the signed license back to the county clerks office next day and see if they record marriage while you wait and give you a certified copied of the marriage certificate.
  • Finish up the AOS/EAD/AP papers with dates--marriage, when you arrived...anything you weren't sure of when you filled it out early. Copy your I-94 from POE. Use the DS-3025 immunization record instead of the I-693. (If you don't have all your immunizations, then you must get them and get a Civil Surgeon to fill out part of the medical I-693. Will add some weeks and $$)
  • Make a copy of the whole lot you are sending (just for reference)
  • Mail it.
EAD card should arrive in 60-90 days.

Everything you can speed up like the wedding, immunizations, documents filled out will get you there faster. Apply for SSN after about 2 weeks of entering US. (K1s). You do not need a SSN to apply for AOS. Write "none" in the blank.

One more thing, since I got all the shots I need, do I still need to fill out the DS-3025?

OK I think this is the answer...

If the beneficiary's vaccinations were COMPLETED as part of the visa process, IT IS NOT NECESSARY TO INCLUDE FORM I-693 IN THE AOS SUBMISSION. All your medical information is enclosed in the brown envelope which was handed in at the POE. The envelope is then forwarded on to USCIS where it will be consolidated with the I-485 submission, once received. If you received a copy of the Vaccination Documentation Worksheet (Form DS-3025) from your Panel Physician, you may include a copy of that form in your AOS submission in place of Form I-693.

On my DS 3025, the doctor maked some shots as age not appropiate, it is ok for AOS or do I have to go thru the missing shots once I get into US?

If they aren't age appropriate for you, then you are excused from them for AOS. Many of the shots are for babies only. HPV is only for certain aged women. Just make sure that the record is complete. It should have a date showing the shot or "not age appropriate." If something has no marking, then it may be a shot you still need in the US.
