To be extra prepared, we want to complete another, seperate affidavit of support incase our primary one isn't accepted for some reason.

We have to use a joint sponsor for the affidavit, but the joint sponsor does NOT make enough to meet the poverty guidelines alone. Can we use the intending immigrant's assets in combination with the joint sponsors?

joint sponsor + intending immigrant = $ok?

The USCIS site is confusing..

" The joint sponsor (or the joint sponsor and his or her household) must reach the 125 percent income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement."

But then again, further down the page it says,

"You may count the assets of the relatives you are sponsoring."

- I think the son in law is counted as a relative?

So yeah, does anyone know if we can combine the intending immigrants assets WITH the joint sponsors assets to meet the poverty guidelines? :unsure:

13 June 2006 - Interview. "not concrete approved", received two emails later same day approving I-485 and I-130. "welcome notice was mailed" and "approval notice was mailed"

17 July - I-485 Welcome notice received and I-130 approval received

18 July - I-485 "after approving your application, we ordered you a new card" email received.

24 July - GREEN CARD RECEIVED! All info correct. Apply to lift conditions 7/13/08

No you can't. You can't just add one's assets with someone else's just to meet the requirements.

I, as the immigrant, am using my own assets, very much exceeding the requirements, but got a RFE nonetheless.... :angry:

Thanks for your reply Clownies. It looks like an intending immigrant can combine income and assets with a joint sponsor, but only in specific circumstances - not applicable to us (typical, eh :whistle: )

Can the Intending Immigrant Help Me Meet the Income Requirements?

If certain conditions are met, the intending immigrant'sincome can help you meet the income requirement. If theintending immigrant is your spouse, his or her income can beincluded if it will continue from the same source after he orshe obtains lawful permanent resident status. If the intendingimmigrant is another relative, there are two requirements.First, the income must be continuing from the same sourceafter he or she obtains lawful permanent resident status, andsecond, the intending immigrant must currently live with youin your residence. Evidence must be provided to support bothrequirements.

However, an intending immigrant whose income is being used to meet the income requirement does not need to completeForm I-864A, Contract Between Sponsor and HouseholdMember, unless the intending immigrant has a spouse and/orchildren immigrating with him or her. In this instance, thecontract relates to support for the spouse and/or children.

The intending immigrant's income and assets can be combined with the Sponsor's income and assets when the immigrant is a Household Member of the Sponsor (must have been a Household Member for 6 months for the income part, unless this is one of the things that's changed with the new policy).

The intending immigrant's income cannot be combined with a Joint Sponsor's income unless, perhaps, the Joint Sponsor is also a Household Member of the Sponsor (and thus the intending immigrant is also a Household Member of the Joint Sponsor) but for whatever reason decides to be a Joint Sponsor rather than a Household Memeber. But that scenario makes no sense if the Joint Sponsor's income is inadequate.

A Joint Sponsor must meet the requirement on their own or with the participation of their Household Members, and you can't be counting people's income and assets twice.
