Hello All,

I would like to hear your insight about my situation. I came to the US on a K3 Visa last March and just like the rest of you, we want to move on as immediately as possible with getting the other necessary documents from the USCIS to be a permanent resident of the US. Apparently, my husband's business is really BAD this year and we have to file for tax extension. With our financial situation, I am looking at January of 2010 to apply for my AOS so as not to burden my husband so much at this time and just apply for an EAD and SSN in the meanwhile. He is doing everything he can and we can only hope for the best.

My K3 visa is good for 2 years. But will a late AOS application hinder my GC approval?

VISA IN HAND: March 6, 2009

HOME: March 7, 2009

FOLLOW UPS:

11.10.08-called up USCIS to inquire about our status/sent faxes to congressmen and senator

11.12.08-called up USCIS again and was told that our case was moved to CSC back in June(!) because the state department have some questions about some of the documents we filed. And they never sent us any RFE...Grrrrrrr!!!! Was told that they don't know what the problem with the documents...Grrrrrr (again)! and was told that they will file a request for review...uuuuuggghhhh!!!!

01.14.09: Hubby sent a Thank you letter to his senator's office for clearing out the confussions with our application last Dec. 4. We'll go with K3...Hubby's doing his ITR as we speak... =)

I would think, as long as you do it before the K-3 expires, you should be fine.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
