hi guys i have some questions

my husband went for his k1 visa interview in casa, he had the mean blonde lady that is so bad....she is really as bad as you all have said by the way

anyway then he had to go back for a second interview a week later and how she is still reviewing saying she is concerned that its not a long term marriage.

my question is yesterday i get the fee bill for the cr1 for 400 dollars. i have already sent the 70 dollars and affidavit of support. so if i pay this 400 then they will send things to casa for the cr1 which of course is better than the k1.

should i wait another week or two and see what this lady decides approve or denied k1 or should i go ahead and pay the 400 now for the cr1

if he gets approved on k1 then we do the aos when he gets here

if he gets apprved on cr1 we dont need to do aos but i have to wait for the cr1 to get to casa and maybe he will have this same awful lady do the interview....maybe she will decline both as is her attitude...so unpleasant

any advice what to do? please help

If you're already married, you can't use a K-1, can you? So you probably better pay for the CR1. And based on your other posting, maybe you should make another trip over there? I can't really speak as to CR1s, but maybe someone else can.

Are you saying that you are awaiting the outcome of the K-1 (post-interview)but since then you have married your fiance? If so, correct me if I'm wrong someone, but doesn't that make the K-1 visa invalid now? He can't enter the US on a fiance visa if he is indeed your legal husband now.

If you file for the CR1 you will have to start over from square one and file the I30. It is a totally different type of visa.

He will have to go for another interview in Casa after his approval, fees are paid and case is transferred which will take several more months.

We filed for the CR1 and it was 8 months from date of filing until his interview but I read that they are processing a lot slower now. This was back in 2007.

Hi Tystie, sorry to hear you're being put through the hoops. Is your husband being asked to provide more evidence for each interview? And do you mean K-3 and not K-1? Sounds like your CR-1 is at the NVC if they've just invoiced you for the IV bill. If so and you pay that bill, your CR-1 is likely to be approved within a couple of weeks, if you don't get any RFEs. The NVC doesn't RFE on lack of relationship evidence though - supposedly the USCIS has already dealt with that - they focus on documents such as police reports and marriage certificates and their translations. However, once the CR-1 is approved, the interview is scheduled about 2 months after that (in my case, anyway).

If I were you, I'd be inclined to see how the third K-3 interview goes before paying the bill, and deal with the AOS once he gets to the US, even though it's more expensive and he won't be able to work for awhile. On the other hand, if he's declined again at the third interview, I don't know how that would affect his CR-1 interview, as you would most likely face the same issues (relationship evidence) at THAT interview. Hopefully others who've faced this can weigh in. This is one reason I went with the CR-1 alone - since they are being processed at roughly the same time, and it seems to create this kind of confusion at interview time.
