for those of you who have had your interview in London and have children.......at what point do they request the proof of permission form the ex partner...do you give it to them with all the other papers when you arrive or do they ask for it when you actually sit down to be interviewed?

I had to get a signed and sworn statement from my daughters father, that stated she can come to the USA perminatly to live.

I was asked at the interview how my daughters father felt that she was leaving and was asked to produce the letter. I was asked for it when i was at the main interview.

You will need a signed (by the child's father), notarized letter (it's called a Statutory Declaration) at your interview. It will be one of the original documents they will ask you for when they gather all your papers before you actually get "verbally" interviewed.

Has anybody been through this without the fathers permission because there has been no contact between the child and father for many years (the fathers choice) and they dont know where the father is. The embassy have told me that because we were never married or gone to court for custody etc, that i would not need his permission, but to get a sworn declaration from a family member or friend which i have. With our interview just 3 weeks away i am getting really nervous just in case i need more.

If that's what the Embassy told you, then I think you're good to go. Did they tell you via email? If so, print it out to take with you.

If you never married your child's father and they never applied to the courts for custody or access, then you don't need his permission to remove the child from the jurisdiction of the court.

That isn't quite correct anymore, the law changed for a child born on or after 1st December 2003.

If the unmarried father of a child born after that date was present when the birth was registered and signed the birth certificate he has parental responsibility and his permission to remove the child from the UK would be required.
