Hello Fellow VJ Members!!

I have a question and I can't seem to get a clear answer. My fiance will be traveling to the US on the K1 visa in June and we plan to get married in July. While we were waiting for the interview, a consulate officer told the room that it would be difficult to travel internationally for the next 2 years. Understandably, my fiance is worried that he will not be able to return to visit his family and friends in Brazil for the next 2 years. I know there is a form that can be sent requesting permission to travel before the green card is issued, but is this only for emergencies? AND will it really take 2 years for him to be able to travel without this form?

No he can travel internationally once he has a approved Advanced Parole document, he can apply for this along with his AOS once you are married. It takes about 90 - 100 days to be approved. As for it taking 2 years to get his greencard that is not correct. It is taking about 5 - 8 months for most people but for some it can take a bit longer but not 2 years.

Once he has his greencard he can travel with no issues. The forms for the AP (I-131) are not just for emergancies it can be use for a visit back home or for business trips.

Two years is way wrong. After you are married and your wife gets her green card you can travel easily. This usually happens within 2-6 months fo filing the AOS which can be done any time after you are married. Until she receives her green card (or AP) she cannot leave the USA and return. The K-1 is a one time entry visa.

YES, with proper evidence of an emergency in the family. I checked on this as my MIL's health is always a concern for us. We were told to make an emergency appoinment at the local office, give the details and evidence and GO. They would send an AP to the consulate in Kiev for pickup. Fortunately we never had to do that but it was good to know. They will not likely do this for normal business purposes, selling property or something like that. Plan on staying here 3-6 months before returning for a visit.

YES, with proper evidence of an emergency in the family. I checked on this as my MIL's health is always a concern for us. We were told to make an emergency appoinment at the local office, give the details and evidence and GO. They would send an AP to the consulate in Kiev for pickup. Fortunately we never had to do that but it was good to know. They will not likely do this for normal business purposes, selling property or something like that. Plan on staying here 3-6 months before returning for a visit.

good to know, thanks. i don't plan on any trips within the first 6 months, but my nana is old with ill health and i doubt she'll live that long, so this is good to know.

we were contemplating a european honeymoon but that seems a bit complicated now. still, i'd like to explore the usa soem more anyway. i've only been to half or so of the states, plenty left to see :)

EPCOT Center in Florida has some European country mock-ups with authentic food which will cost you almost as much as flying to the real country and eating dinner...if that would help. :)

ah, i'm in no hurry to return to florida. i've been to europe a couple of times, once with my fiance, so we're ok there.
