CAN SOMEONE HELP ME

me and my fiance filed in may of 2008 and we gave all the originals we had if we have to file again do i have to give originals again or can she give them the copies we have

I think we'll need a little more information to help you out:

You filed a K1 in May of 2008...why would you need to refile and what are you planning to refile.

When you talk about "originals" which originals are you speaking of? The entire file? The I129? The G325s? Birth certificate? Pictures?

Did you received an RFE?

me and my fiance filed in may of 2008 and we gave all the originals we had ..if we have to file again do i have to give originals again or can she give them the copies we have. well what happened is this I applied in may of 2008 and in agust of 2008 they requested more info and they sent me a fax number as well as the mailing address and I faxed it to them and then i called and called to make sure they got it but no answer so i thought maybe they got it when i asked about them changing the status they told me not until they get to your case in anycase we waited 11 months this month will make one year but i called my congressman and he found out they had closed the case for abandonment and that was not true i never got any mail from them saying they did not get the info or i would have sent it again this time i would have dont overnite like before but i found the reciept from the place where i faxed the info to them to show the congressman that i did infact send it to immagration and they sent it to vermont center and so now we are waiting for them to say either they will continue with this case cos they made a mistake or we will have to file again so by monday i am calling the congressmans office again to see if they heard anything from immagration yet i pray they will open the case again and just make an approval for us instead of us filing it is to long omg we are crazy at this point immagration does not play fair with people pray for us so is it enough if i sent only copis of his birth cirtificate because i sent his originals when i appled the first time ty

Ok - so you filed and got an RFE. You faxed the missing information but it appears USCIS did NOT get that info hooked up to your case. You've only recently found out that they closed your case based on abandonment. You have the receipt from the fax and have your congressman working on re-opening the case for you. Correct so far???

I would wait to see what your congressman says. Having the case be re-opened would be the easiest/best. However, if you need to refile, I would get all updated information, the G325 specifically asked for dated address and work history information. Also, the G325s need to have original signatures. The clock will reset with respect to the 2 year meeting requirement too so if you refile this month you would have had to met since May 2007.

If I were you, I'd wait and see what the congressman's office can tell you. Hopefully that will be resolved quickly. Good luck.

Don't worry, Marie_yahya. A 'mod' is a person who makes sure things go smoothly on the forum. I am a mod so I just took your other two posts that were in separate places along with the answers you received there and put them all together in one place so you have all the information in the same place. That makes it easier for others to answer you as well and easier for you to find the answers.

A 'thread' is a series of posts like this one all about the same thing. So you had started 3 separate but identical threads and I combined them into 1 thread. I hope this helps explain what happened.

About his birth certificate you will have to get him to get more orginial copies preferably at least 3, you should also have him go to the courthouse and get at least three original copies of your marriage certificate as well, those are the two big ones which requirements are for originals.

I only say get more original copies of birth certificate because you will have to send one to NVC. I never sent an original or copy of his birth certificate with the i130, I just sent a copy of his passport....

I never sent originals only copies. I would verify your address with them, maybe they sent an RFE to a wrong address and that's why you never responded and they considered it an "abandoned application". Good luck to you.

Just send photocopies to USCIS you need to keep the originals for embassy if you are filing K1 or for the NVC if you are filing CR-1/K3
