Oh, *Len* - I think they are saying if you have a waiver for something, they can't use what the waiver waived to deny you..... :)

to many waves here weeeeeeee

i need my meds now :)

(and your correct, the AOS can be denied for other reasons that are not covered by an approved waiver)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Are you sure about this? How do you know?

I applied for a waiver for my wife back in 2000 for a K-1 visa. My attorney misconstrued a request for additional information as a denial, so her and I got married and moved abroad. 6 months later, an approval for our original waiver came in; but, we were told by INS that we would not apply, as we were already married. We would have to seek another waiver if she would come in on an IR-1.

That is because you no longer qualified for a K-1 visa, since you got married. It has nothing to do with the waiver in your case.
