Travel after marriage

Timeline

Not sure where to ask this question, this seemed close for a theme.

She will arrive in July. We will marry before September. She wants to return for 6 or 8 weeks in October to assist her daughter with the first grandbaby.

Assume that the day after the wedding we submit appropriate documents for AOS.

Will she receive a Temporary Green Card at that time or can she obtain something else that will allow her to leave the country and re-enter after the crying baby drives her away? {grin}

Thanks in advance for any who can answer or steer me to the thread with the answer.

No such thing as a temporary PR/Green Card. When you submit your I-485 (AOS) documents you should also submit an I-131 (AP/Advance Parole). AP is used to re-enter the US while waiting for the PR/Green Card. (Typically good for 1 year and if requested, can be used for multiple trips.)

It is advised that the foreign national not use or be very cautions of using AP if they have/are-on an overstay or out-of-status though.

Moving this to Work/Travel prior to green-card forum.

You need to file an I-131 for an AP document, note the dates you wish to travel, and perhaps USCIS will issue an AP document in time for the trip. You cannot travel without AP document or green-card IN hand, doing so will get AOS process canceled, and will then need to file an I-130 for a spousal visa.

Exactly. You might want to consider marrying in July (asap) so you can file AoS and AP papers right away. Probably her only chance of getting the AP papers in time to travel in October. It's still pushing it though.

The other option would be waiting to come to the US until after the baby. She has 6 months to travel to the US once she receives the k-1 visa which you know is for one entry only. So if it's that important, waiting 3 more months might be worthwhile. Then you could be more leisurely about planning your wedding.
