Not sure what section this falls under

I'm not sure what section this falls under, as this is all new to me. My fiancee is Jamaican, and I am part Jamaican but have lived my whole life between Canada and the US..so not a Jamaican citizen. We recently got engaged and realized what a process this all is. We want a year togeather before our wedding..partly to raise money for our future and so on. We looked into all our options and discovered other than a visitors visa which he cannot work on..there is little realistically to bring him over here without us getting married.

My dad owns his own company and thankfully offered us a solution. He is going to send my fiancee a personal letter hiring him to come work for his company.

Now I called a lawyer friend in Jamaica and he said this is a easy way to get him here in comparison to the other ways..and that he should have no problem getting his work permit as he already has a passport and everything.

My question to all you...is how do I do all this.

What has to be in the letter my dad sends him??

What does he need to take to the embassy with him when he goes in with the letter and his passport??

What all is involved with this process and what do I need to know?? I basically want to know everything so I can get this started asap.

Thank you all sooo sooo soo much for your help...it makes this process alot to have the facts of the process given to me in a matter of fact form and not a eighty hour call to the embassy which tells me nothing!! :blink:

Not sure, but this falls outside of VJ's realm. I would think your dad's company would have to sponsor him for an H-1(work) visa....but I have no idea how that is done. Perhaps you can look into work-visas and what their requirements are and procedures to obtain one.

I'm not sure either, but there are multiple types of work visas depending on the kind of work (not just H1's) Also, the specific process may differ for the various visas / situations. It is possible that your dad my need to send a petition to the USCIS before he can apply for whatever visa, I don't know. Read the guides on the www.uscis.gov site.

01/14/2009 -- she flies to USA, stuck overnight in Frankfurt

01/15/2009 -- she arrives in USA

01/16/2009 -- proposed! she says YES!!! :)

02/14/2009 -- 6 days of bliss in Walt Disney World (6mo given on I94)

02/23/2009 -- sent I129F Next Day Air

02/25/2009 -- NOA1

03/01/2009 -- Touched

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)

Just getting a job offer isn't enough to get a work visa. As stated before do some reading up on work visas. It depends on what type of job, your fiance's skill set, and more.

For example, I cannot just hire my brother in law to work in my restaurant and bring him on a work visa. If it was that straight forward, he'd be here now. :)

If you want to migrate to Jamaica, you'd have to look at Jamaican immigration laws, which I doubt anyone here can help you with.

No special visa is needed for you to marry here if he does not intend to stay, however the stay would be limited to less then one year normally and he wouldn't be able to work legally. If what you want is for him to have the ability to simply stay here for one year, then marry, then move to Jamaica, then a work visa could indeed help with that *if he can get one*. Possibly another option could be a student visa if that is of any interest.

Does he have a degree in the area that you wish to sponsor him which would be required for the job?

Really something for your Father's Company Immigration Lawyer.

My guess is that you would be best moving to Jamaica.

I doubt that this work visa idea will work. One of the first questions at his consulate work visa interview will be "how do you know this US man/company?" He is under oath and will say "through my girlfriend/fiance". Likely response: Visa denied.

My brother in law tried this work visa approach in the Dominican Republic and was quickly denied.
