AOS Filers - May 2009!

Hi, I am a Canadian as well who has married an American man in '07. By tourist visa do you mean your I-94 that you filled out upon entering the US. Did you state that you were immigrating to the US? The reason I am asking is because it says in the guides here that if you file an AOS (I-130) to change your status from a tourist that it can be fraud and you can be deported. I am in Louisiana with this problem. I came across in Buffalo by car so I don't even have an I-94 but I think it is implied. Anyway, any thoughts you may have on this would be helpful.

It's not fraud if you came into the US with NO intent to get married. It's the intent that will catch you.

A lot of Canadians don't have I-94's. How my lawyer told me to deal with it was to write up a sworn letter stating that I came here as a tourist, with no plans to stay and that I was inspected by a customs agent. I also attached a photocopy of my plane ticket that has a stamp from the customs officer on it.

Someone I know (from another forum) did this as well and they said it was fine

If you have any type of evidence that you can obtain (a letter from an old employer ect..) that showed had employment during your visit down here, bring that to your interview. I worked for my uncle and he was able to write up a sworn letter for me as well as a rental agreement I had with my parents (about paying rent, bills ect...) So I'm going to bring all that with me incase they ask

Congratulations to everybody who recieved the NOAs now.

I went to my biometrics appointment today (earlier than supposed to) and I had the same experience as rexalite. They first made a big big deal out of it that I am earlier than my appointment. But I just kept explaining why and then they finally processed me. It was totally empty there (I was the only person) so I don't really see why it should be such a big deal. And on the USCIS website it already shows as being updated today. So we will see how everything will go on now.

Oh god all that waiting makes me crazy....

got my biometrics appointment letter on thursday! my appointment is on the 6/5/09!!

I tried to check my case status online, but it always says that my case doesn't exist...?? any ideas???

Hello!!! My husband and I were married May 9th and sent off the AOS packet yesterday. YAY!!!

I have a question that I seem to find different responses to, depending on where I look. VJ really seems to be the most reliable.....with the most AWESOME people, of course. LOL

When waiting for the status adjustment, does the EAD come AFTER the biometrics appointment? If it does, how long does that typically take? I also noticed that you can file for that on-line and a few people had posted they got their EAD within 2 weeks after they did it like that but I imagine they had to pay the additional fee. We obviously sent it with our packet.

I think I've just managed to bombard myself with too much info from too many different places and gotten myself a bit confused. The EAD is used to work legally while your adjustment is pending correct?

EAD may come early, but ideally it should come within 60-90 days....

Yes, EAD would allow your husband to work officially till his status is pending.....

Its in the last part of the I-485, you didn't fill it out because you did it yourselves, I filled everything out for my husband, thats why.

I went and got my biometrics done today. I got the letter yesterday with a June 2nd appt. Just to let you all know, it didn't seem like an automatic thing to get in ahead of time. When the security guy asked for my appt letter, he was really surprised I was there 1.5 weeks early. He asked me why I came early, and I said that the appt time I was given (8 am) was really inconvenient as it is a 3 hr drive for me to get there and I'm not a morning person. He opened a door to an office area and asked a woman I couldn't see if they would be able to process me. The lady asked what I was applying for and there was a couple minutes delay before she authorized me to come in. I felt like they could have turned me back.

I have no idea if that is common, or what, because they did process me, and it only took about 15 minutes, including wait time. Just thought I'd let you all know in case anyone else has to drive a long way to their appt.

Well, at least you got it done. And doesn't it happen a lot of times in the US that if you do something "out of daily business" that it is a problem at first?

Oh no, it didn't make me feel bad at all, but it would have if they turned me away and I had done a 6 hour drive for nothing. I feel great to have it done! I just wanted to let people know, it seemed like it wasn't an automatic or expected thing to show up way before your scheduled appointment.

Tahoma - my husband and I lived in Seattle for awhile, in the Green Lake area, on Ravenna Boulevard. Loved it! Go have a lamburger at Matt's in the Market for me! I miss Seattle a lot.

Kelly - I didn't apply for AP either, sorry!

Rexalite - We live just 5 minutes drive to Green Lake. It is a beautiful park. Will eat the burgers for you this weekend.. B)

Kelly - AP will allow you to travel to your home country when you still have not received your GC. This will be useful in emergency cases, since we never really know when we will get approved. You don't have to pay an extra fee for AP when you file this with your I-485.

Does USCIS work on holidays? I am really surprised that my case has been updated yesterday? I checked it this morning and it says last updated May 25. This is weird.

Any news from anybody else?

Not sure why that is but some people do go through the whole process without ever having their case showing or being updated online. Maybe we will be the same

kiwiana, it's very strange why ur (or many others like u) cannot see their status online....i checked my status as soon as i received the NOA in mail and it was there....

is this the link u r looking at? coz may be u got redirected somewhere else....and ofcourse, use no dashes in the receipt number
