I am a Canadian citizen, my wife to be is an American citizen. We plan to get married on June 7, 2009 and begin the CR-1 application directly after the marriage certificate arrives. I live and work in Canada and plan to do so for the time period it takes to obtain my LPR status in the U.S. However, my sister is getting married in the U.S. a few months after I am. My question is: will I be able to cross the border from Canada into the U.S. to attend my sister's wedding even though I will be applying for LPR status in the U.S.? I was under the impression that I could not cross the border once the application process begins. Is this true or a fallacy?

Sure you can, just try to have as much evidence on hand when you go through Immigration so you can explain that you don't plan to stay living in the US until you receive your CR1 visa.

Sure you can, just try to have as much evidence on hand when you go through Immigration so you can explain that you don't plan to stay living in the US until you receive your CR1 visa.

For example, lease agreement for apartment/house, proof of ongoing employment outside of the US (like a letter from your employer), if traveling by airplane, return ticket. (In your case, maybe also the invitation to your sister's wedding.)

I took all these documents. They did not ask me a thing. However, it is good to be prepared, just in case they do ask proof.

I'd also take the receipt number you will receive from CIS for your I-130 application, so it is clear that you are not hiding anything.

I will be visiting my husband and we are pursuing CR1-IR-1 too..Make sure you got all the below documents and read the below thread.

Return ticket.

Copy of lease/rental agreement or mortgage payments for housing.

Letter of employment indicating expected date of return.

Copy of class schedule or other pertinent documents if in school.

If arriving on an extended stay, copy of bank statement showing sufficient funds to support yourself.

If you do not appear to have the means to support yourself while in the U.S. a letter from whomever you will be staying with stating that they will be financially responsible for you during your stay.

If you are leaving a child behind in the care of someone, a letter from them stating when you are expected to return.

Copy of the K-1/3/IR1/C1 application and any NOA(s) received.

I haven't had any problems crossing the border to visit my husband. I just make sure I have proof of my ties to Canada in case they ask. I have never been asked to show proof, have been asked verbally.

So if you have proof you intend to return to Canada , you shouldn't have any problems
