Hi everyone,

After the USEm denied me for K-3 visa ( No petitionable relationship to the petitioner) can we pursue to CR-1 route using the approved I-130 of denied K-3 or we have to file a new I-130?

My marriage is still valid according to a lawyer. I can only file for annullment if choose or have other ground which i don't have.

You can follow up with the CR-1 but that won't change as the reason the K3 was denied is still there.

Sounds like you need a lot more evidence of having a loving bonafide marriage.

More trips and photos may help. The petitioner attending the interview is a plus also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You can follow up with the CR-1 but that won't change as the reason the K3 was denied is still there.

thanks Haole.. We married in good faith and he believe that our marriage is genuine this is what the CO told my husband. CO said the only problem is the marriage license and we have to see a family lawyer first. The FPU officer indicated on the paper that our marriage is voidable and need to get it annulled but it is valid and we can not file for annullment without other reasons or grounds according to a lawyer. So i don't see any reasons at all to get it annuled.

Marriage 101: Fraudulent license =NO LICENSE = ergo VOID marriage.

Voidable marriage is valid until annuled.

Void marriages has an effect that it is neither valid and is inexistent.

proving a loving relationship has no effect on this. this is legalities that we are talking about.

If you're not too sensitive, you can put in here what happened to your marriage license.

i wouldn't go in on an interview just yet... you may encounter another CO and that CO may consider your marriage a fraud in case your Marriage license is questionable. Also, material misrepresentation is a no - no. Your questionable marriage license may be construed as material misrepresentation.
