Hello Everyone

I am new here and I need some advice. I am an American citizen and my fiancé is a Mexican citizen. We are considering a K-1 visa since from what I hear it is faster than a K-3 visa. I have known my fiancé for many years and we started dating in December 08 and became engaged recently. I am currently living in Mexico with my fiancé. The process of a K-1 visa seems pretty straightforward, but the interview process scares me a bit.

Here are a few questions I have:

How difficult is it to get a K-1 visa when your fiancé is from Mexico?

Have we been together long enough to apply?

The only problem we have is when I was in the USA I was a full time student so I didn’t work. I was told I would need a cosponsor, which my mother has agreed to. Does this complicate the process?

Is it necessary given my situation to hire an attorney?

Please help any advice is welcomed.

How difficult is it to get a K-1 visa when your fiancé is from Mexico?

If you've met the minimum requirements, and your fiancé has had no immigration issues in the past, being from Mexico should pose no great difficulties - many folks here on VJ have had much success.

Have we been together long enough to apply?

It isn't a matter of being together - it is having met in person (within the past two years) and being able to show evidence of this. There's no time constraints on how long a relationship is/has-been.

The only problem we have is when I was in the USA I was a full time student so I didn’t work. I was told I would need a cosponsor, which my mother has agreed to. Does this complicate the process? This is nothing new - many folks have been successful in your exact position.

Is it necessary given my situation to hire an attorney?

Most folks find the process is straightforward and do without an attorney - your situation may/may-not be any different.

1. K-1 could be difficult and could be easy, just be honest with the questions on the form and during the interview, if you have any doubts, lets us know and we can advice more....

2. you said you have known your fiancee for many years, so that sounds like it's enough.

3. Co-sponsor will not complicate the process

4. study the guides here on VJ and if you have questions ask here and you will not need an attorney.

Thanks for the replies. I am just a bit nervous it’s a lot to take in. I am going through the guides and forums to get a better understanding of how the process works. I am sure I will have more questions in the near future.

As far as him have immigration issues there are none. He has never been to the USA and he doesn’t have a criminal record.

How long have you been living in Mexico with your fiancee? If over six months you may be able to marry and do a DCF and get a CR-1 immigrant visa.

WAY better than a K1 or K3. Also faster than any other type of family visa.

I have only been in Mexico for two months, but before that I was here in December for a month. I went home in January and returned on March 5.

I know I still have a long way to go but I was curious as to whether or not the interview could be done at the US Embassy in Mexico City or is Juarez the only Embassy that processes K-1 visas.

IF she did want to marrie in mexico she would need to be there least then 6months ( Sence that is the longest permison they give u to be in mexico ) like america / mexico gives u a like visa and its by law so its better not to over stay without permison in mexico i go 6months at a time to mx. I make sure i do everything by law anywhere lol Im 23 and neaver had going a ticket by the cops r anything lol and the interview is only in juarez they r the only ones who pro. k visas

02/06/2009-Noa1

04/27/2009-Noa2 Approved :)

05/02/2009-noa2 Hardcopy in the mail :)

05/18/09- Nvc case number and Ds-3032 also paid Aos bill

06/16/2009- paid IV bill

07/20/2009- sent out Aos ( yea I paid everything now im sending it. I was out of town with my hubby for 2months Thank God they let us pay online now only if we could send everything else online lol )

07/30/2009- Sent out DS-230

08/12/2009- Case Complete with NVC

09/01/2009- Visa interview has been scheduled for 10/05/2009. Letter by email.
