Hey guys, so I am in the AOS part of the process for a CR-1.

I have a few questions.

First of all, some background.

Before I got married I was a student with basically a work-study job as a tutor at a college.

I really didn't make money and wasn't required to file taxes because I made such little money.

I did a couple of times, not that it mattered, I was only paying into SSI and some Medicare stuff, due to work, never got any money back.

After I graduated, I moved to my husband's country, to see what it was like...try it out whatever.

I didn't work for the first half a year, then I became employed in the International School system.

I haven't gotten any W2 stuff for the past couple of years, and owe nothing in taxes according to the IRS.

I make below US poverty line in wages.

I also have my folks joint sponsoring...they make way above 125% so there is no problem there.

My questions are:

Do I put my foreign employment information on the I-864, or do I put myself as unemployed?

Should I attach a letter to my I-864 explaining this situation to them, as I have no assets and don't really make much money?

I got papers from the IRS on what transcripts I do have (2006 being the last time) and I have W2s from what little I made at the beginning of 2007, as well as non-filing letters...I should include those, yes?

Any insight would be helpful!

You should put on the I-864 exactly what you are - if employed, list it, if not, list that. You should complete the form with the information that is true and correct (good, bad or indifferent). You may write a brief letter explaining why you did not file taxes as well. :thumbs:

That's pretty much what I thought...they just won't count my foreign employment as anything toward the support since I won't have that job once I move back to the states.

No biggie though, that's why I got a joint sponsor. :)

Also wanted to add that YES you do include your non-filing letters, as I've seen quite a few people get asked to bring those for verification after their interview. Yes it holds up the process to not have all the necessary papers already sent in.

Marriage : 2008-07-03

I-130 Sent : 2008-09-30

I-130 NOA1 : 2008-10-03

Dec 22 2008 Transferred to California Service Center

I-130 Approved : 2009-01-12

NVC Received : 2009-1-16

Officially in AVR : 2009-1-17 emailed scanned DS 3032

DS 3032 generated and accepted via email/ AOS I-864 generated : 2009-1-23

Received I-864 Bill : 2009-1-26

Pay I-864 Bill : 2009-1-26 status PAID 1-28

Pay IV Bill : 2009-1-26 status PAID 1-28

Send Completed I 864 and IV Package (overnight) : 2009-2-4 (had to wait for hubby's PC and original birth certificate to arrive)

Case Completed at NVC : 2009-2-11 !!!!

NVC Left : Received email March 3rd

Medical Completed : March 12, 2009

Interview Date : April 22, 2009. 8 am. VISA APPROVED!!!

Visa in Hand : April 27th, 2008!!! Arrival May 11th! POE JFK

Processing Estimates/Stats : Your I-130 was approved in 101 days from your NOA1 date. NVC completed in 26 days! Interview was 201 days from Noa 1.

Follow-up question as to the letter to attach to my I-864...

What information do I need to put on the letter?

Do I put case number and all such information?

Or is it just a letter titled: "Explanation Regarding Current Financial Situation/Non-Filing of Taxes?

Sorry, I just get so confused by all the red tape and stuff :D
