Is there a petition expiration date?

Timeline

Our receipt date is June 15, 2007.

Our NOA2 approval date is Dec. 14, 2007.

We wish to move our I-130 forward and drop the K3 or keep the K3 which ever first so that we can be together. I don't care. On the NOA2 it says if you are petitioning for a person outside the United States the petitioner should file the I-824, which myself and my Mom have completed, and send a letter of request to move the I-130 to the NVC.

My only simple question for them was "Do the petitions expire?" They kept repeating and giving me the red tape which is so irritating. Why do they even have a live body there if it's just going to be automated like that. They kept repeating that I have to make an info pass and they only provide general information. Isn't that a general enough question? Guess not because they kept passing the buck to my local office.

BTW my local office is 8 hours away and I'm in the middle of finals! I checked their information doing like they requested going to the sight www.uscis.gov and looking on the left hand side to make an info pass appointment. I selected it and started to make the appointment but with the options they give there is no option for me. They only offer four kinds of appointments and none of them have to do with my question. So I went back and selected aquire information which leads me right back on the merry go round to USCIS. Total Bullsh1t! Plus none of the dates on the calendar for the info pass appointments at my local office were available for me because I'm in the middle of finals here and leave for Egypt for the summer in 20 days. Why can't they answer one simple question so I'm not wasting my time trying to push this thing forward?

The only petitions that expire are K-1 I-293F petitions, 4 months after approval, but in this case most consulates extend them.

Is the NOA2 for the I-130?? Your post indicates approval in 2007?? Need more details, did you file an I-129F for a K-3??

Maks no sense that USCIS did not send the petition on to NVC after they approved it.

Did a US citizen or green-card holder file the petition for a spouse?

Yes I, the USC, sent the I-130 first and then the I-129F second. We filed for the K3. This was before all the changes happened and they had that mass rush of applications because of the increase in fees which I knew nothing about and got stuck in waiting for an approval for 6 months. The K3 is currently sitting at the Embassy in Cairo right now for the past 16 months because my Husband was taken into the Egyptian Military so they put us on hold. Today is his official release day April 30th. So now we're trying to get the petitions resurrected. The I-130 stayed at USCIS instead of going on to the NVC. I don't know why. Maybe it was part of their process back then? Thank you for the answer though. I don't know why they couldn't have just given me that then.

In this case contact DOS visa services and ask about the K-3 case at the consulate, more than likely the consulate can get the ball moving again.

No sense in trying to get I-130 moved to NVC for an IR-1 visa, better off doing the K-3 and then adjusting status in the USA.

I've emailed the Embassy twice in the past two weeks and still no response so maybe it's not their job anymore. Hubby is collecting packet 3 as we speak for the K3 but we don't know if the cut off date is the same as his release date April 30th?

I think its up to the consulate to renew the k3, not DOS. I asked the same question when we got stuck in AP at NVC, I was worried that our 129f(k3) would expire before he got an interview scheduled.

Cant find the email right now, but the consulate basically said... we can extend the application as long as necessary, based on the circumstances.

I agree that trying to get the 130 through NVC now would just hold you up longer.

Hopefully the consulate will answer you soon :)

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks Lisa! I hope so too. Waleed is getting all the packet 3 paper work now that he is released and I'm telling him hurry! He is saying he doesn't know if he will have it all before I arrive May 20th in Cairo so don't be mad at him. :P I love him to bits! He's so cute. I know how Egypt is. I just wish the consulate would write back with an answer.

Is it time for me to get my Congressman involved? He's speaking at my commencement ceremony this May. :D

I called: 202-663-1225

The options I had to go through to reach someone about our case.

1, 4, 2, 3, 3, 0.

They said:

Package 3 sent out on April the 6th this year to his home address.

There is no interview scheduled at this time so we are still on hold. This is good news at least. :D
