Hello friends

I really need help in this matter. I'm from India, my family is planning to arrange my marraige with a girl who has family Green Card and currently staying in India for and vist USA couple of times in a year.

I would like to know that is their any way she can file gren card after marriage ( I know it takes a lot of time for me to get a green Card) is thier a way out atleast legally I can work in USA.

Or what is the procedure she can apply for citizenship and how long does it takes?

Please provide me any solution in this situation.

family green card? not sure what this is... as far as I know each green card identifies an individual permanent resident... resident status must be mainitained... a couple "visits" a year sounds like they have given up residence and are now living someplace else

As a spouse of a resident you would be classified F2A... Currently there is better than a 5 year wait for a citizen of India to immigrate as a spouse of a LPR...

Your future spouse would be better off getting her citizenship... but if she really does not live here then that will be impossible..

Other options would be a H1B or some other work visa but that requires a sponsoring employer

Visa lottery?

If I'm understanding this correctly it sounds like they girl your family is arranging for you to marry currently has her US permanent residency (green card) but lives in India and visits the US a few times a year? If that's correct then I don't understand the second part of your post where you ask how she can file for a family green card? Or are you asking if she can file for you so you can have permanent residency?

If she's a permanent resident then yes, she can file for you but like you said it will take a while and the USCIS may find an issue with the fact that she lives abroad and not in the US. She can also file for her US citizenship but again, given the fact that she lives in India and not the US she may have issues with that as well. If she does get her US citizenship then she can file for you and processing won't take as long.

gpk, you got all wrong informations. From what you state, you won't be able to come to USA if you marry her as she is not USC yet.

How and when she can acquire, its a different story and we need more infos about her. As of now, its NO.

If she doesn't live in USA then she is on the verge of being presumed to have abandoned her residency (greencard) so it will be as if she doesn't have a greencard. Comprende! You are marrying an Indian woman who used to have a greencard (may o rmay not be honored if she tries to come back here next time) and unless her family can sponsor you as an employee of their business or something like that - you don't get a greencard!

Look for a girl who not only has a greencard but who is also living in USA (preferably she is close to her citizenship - meaning she has had her greencard for 5 years - then you won't have a long time lapse for getting your greencard - she will need to get her citizenship first).

For others to whom this looks strange - it's common to marry a girl/guy who you do not know (arranged marriage) in India - so if his desire is to live in USA, he needs to look for another woman. Its not like here where you want to marry someone becauseyou love him/her and then you worry about visas etc. next. Good Luck
