We are preparing our AOS and as my wife was in Ireland in 2007 she did not file a tax return. We read that you should submit a statement of non filing to state this. Is there a template that we can use? or has anyone else had a similar experience?

There is no standard template that I know of, but I would think using the Buisness Standard Letter format will work.

Why didn't she file?

If it was because the income was too low, then just a written statement is needed, but if it was because there is another reason, you will need additional evidence to show why.

Sign and date of course.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If she had no income/job and was a student - that is all you have to show in the statement, as per the instructions. (if you wish, you can toss in her school transcript.)

The evidence part is if you made income and you were able not to pay taxes because of some rule/law that was possible for you. Which is not your case, since she didn't work, since she was a student.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

A statement that she was a student, not employed and had no income. It doesn't matter if she was in Ireland or not if she had no income. Alternatively it may be just as easy to file a 1040EZ, claim -0- income and be done with it. If no tax is owed, there is no penalty for filing late. You can download prior year tax forms on the internet, do a search for "2007/1040EZ" for example (or whatever year you want the form for)
