When your I-94 is expired and you do not have any proof that you are processing your AOS (NOA1,NOA2,biometric letter) you are considered as an illegal immigrant. Believe me....Our car was pulled over by the police border patrol in Texas and Arizona (not on the border sites even) and the K1 visa and expired I-94 are not good enough for them. We were stranded on the highway of Indiana by the highway patrol FOR 3HOURS because my visa and I-94 was expired. We showed them our supporting documents (AOS papers:NOA1,NOA2,Biometric, and certified copy of our marriage certificate) and it was ok. The border patrols are familiar with these AOS paper and let us go after seeing all the paper. However, most of the higway patrol or the police will not consider the K1 visa and expired I-94 as the valid ID. They even confuse with the AOS paper and let us wait while they are calling the immigration to confirm my AOS status. My suggestion will be file your AOS or get your EAD soon.

EAD Approved Date : 2009-03-17 (162 days)

EAD Card Received : 2009-03-20

GC Approval : 2009-04-06

Greencard Received: 2009-04-23

GC approved without the interview after 6 months and few weeks. The case status online is still with the last touch on November 2008. Don't open that website too often..:-)
