Timeline

Here is my story in a nut shell, In September of 05, I filed a I-129f for a fiancé, Well in went until December of 05 before it was ever touched, when it was touched I got a REF for more evidence of our relationship, I sent more pictures and letter from family, however that was not good enough so the petition was denied due to lack of evidence for our relationship. So in January of 06 I hired an immigration lawyer to help us, he said our best option was to get married in Mexico when I go visit. So we did. Came home will tons of pictures, plane tickets, receipts ECT. Filed my I-130 in April, they received it in Vermont on May 1 2006; the case had not been touched since May 2, 2006, we filed our K-3 in May they received it on May 22, 2006, that has not been touched since June 1, 2006 So what I'm afraid of it is going to sit there for months and get dined again, because I look at other people's time lines and they get touched all the time and mine has not. Please if you can shed some light for me. I so depressed and frustrated.

12/24/2006 Rec RFE

12/24/2006 Mailed back RFE

01/17/2006 K-1 diened due to lack of evidence we meet in person.

02/06 Hired immigration lawyer

03/24/2006 Left for Mexico to see my honey who had been gone since 09/16/2005

04/01/2006 Got Married

05/01/2006 VSC recieved I-130

05/17/2006 MSC recieved K-3

07/01/2006 Recieved RFE for K-3 IMBRA law

07/14/2006 Usps said MSC recieved package

07/25/2006 I-130 Transfered to California Service Center (????)

08/07/2006-Touched I-130

08/07/2006- I-130 Approved (99 days)

08/07/2006-K-3 Approved (83 Days)

Here we go again !

Lifting conditions

Oct 14th 08 ..... Mailed the I-751. Back in the system we go

Oct 18th 08 ..... NOA receipt date

Oct 20th 08 ..... Check has been cashed, waiting on the NOA1 and Biometrics appointment now.

Oct 24th 08 ..... NOA arrives in post.

Nov 13th 08 ..... Receive date for Bio-metrics in Atlanta.

Nov 28th 08 ..... Bio-metrics appointment.

Feb 18th 09 ..... Date of decision to remove conditions on permanent residency.

Feb 23rd 09 ..... Received notification on approval ( via snail mail ). Green card on order.

Feb 26th 09 ..... Card production ordered. Pleas wait 30 days ( as per case status on USCIS home page ).

Mar 7th 09 ....... My 10 yr green card arrives.

Apr 22nd 09 ..... Sons 10 yr green card finally arrives( after a nudge at VSC from the USCIS helpline)

Going to take a little break from the immigration stuff.

Hi Traci

I know you have concerns because of the denial and that is understandable but don't be stressing yet, its way too early for that and you will give yourself an ulcer. What is happening with your I-130 is well within normal. As for the I-129F for the K-3, you are just going to have to be patient as ALL petitions filed on or after March 6 have just about come to a standstill so it is not specific to your petition.

I have been around working alot so I can save some cash to go visit my hubby in December, I just keep having flash back of what happen before. it is scary you know.

I can understand that *hugs* But your I-129F for fiance was denied for a specific reason that wont have any bearing on the spousal petitions being approved as you didnt need to submit evidence of having met like you had to before. Try to relax traci (F)

Not yet. Am leaving here mid July so will be landing in FL smack bang in the middle of hurricane season :blink: Keeping myself pretty busy with packing and time with the kids and grandkids.

Unless tracimn provided us with mis-information (quite possible, it's a common occurance here at VJ when people don't appreciate the significance of the words they use) the reason why the previous petition was denied will have a bearing on the current petitions. She told us that the first petition was denied on the basis of a dubious relationship, not on the basis of not having met within the prior two years.

Getting married may mitigate some of the doubt about a relationship, but it does not eliminate all of the doubt.

Choice of words is often the case yes, however I remember traci's case well and she failed to be able to prove that they met in person within the 2 year period required hence why I made mention of it in my post as it not being something that will affect the approval of the spousal petitions as it is not a requirement to show that one has met within that period as is for the fiance petition.

Currently, it is taking minimum 3 months for the I-130 to be approved based on VJ members' recent approvals. So you just need to wait for the approval at this point.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
