My fiance should be coming in May using a K-1 Visa. In June/July I will probably be buying a house here in the states. How do I put her name on it if she won't even have government ID yet? Is this possible? Would they just need our marriage cert?

By 'on it' do you mean on the mortgage? or on the Deed?

I read that for AOS that her name should be on the house....does this mean the deed?

The thing is that I want to get a Prenuptial Agreement (I would do that with anyone not just because we are from different countries)

If you bringing your girl over from PI. I doubt you will even have AOS interview. Most K1 get GC in mail w/o Interview, a few months after submitting AOS application.

If it were me, I wouldn't put her name on the house. Keep what you have or will have in your own name.

If you get a bank joint bank account make sure she is putting money in it also.

You can open another account and keep "your" money in that one

Texas is a Community Property State.

It is wise to get a Pre Nup.

Another great benefit from a Pre Nup is if your wife happens to screw up her credit rating in USA or Vice Versa.

Since you have pre nup the other party wouldn't have thier credit score effected by the other partner poor credit rating...

Adding spouse to home title is NOT a requirement for AOS, what if you don't even own a home??

The only marital relationship evidence required by form I-485 is a marriage cert.

Marital relationship evidence comes MUCH later when you remove conditions on a conditional green-card, having spouse listed on a deed shows living together.

I-485 only requires, marriage cert, passport pic, copy of I-94, copy of visa and bio page from foreign passport, copy of foreign birth cert + English translation.

She should be able to have her SSN and some sort of government ID by then, and of course she has her passport and K-1 which are government issued IDs.

No, it is not required for AOS. My wife was not on our house deed, not on any of the utility accounts and we had only a joint bank account together. No questions asked at the AOS interview.

I had very similar concerns.

We filed our I-129F for K1 last Sept, and hopefully should be getting our interview and visa shortly. In the interim, I bought a house in Feb and have it titled in my name only. The mortgage as well is in my name only. When she comes and we get married it will be our shared home. I'm intentionally deferring all the fun parts of making it a home (renovations, furniture shopping, landscaping etc.) till after she gets here so she can be a full participant in making it our home. Eventually in the fullness of time we may add her name to the title record, but that's not a priority for us. As pointed out by others, there are many other ways to prove that we have a genuine relationship when we will come to Removing Conditions. Having her name on the deed is not needed for that.

As to prenup, we did one last Sept when I was in Thailand with her. I wanted it done there so it's in Thai, with an English translation. When we get married we'll file a copy of it when we register the marriage. I wanted the prenup because I've been married before and after a messy divorce and ongoing support obligations felt I needed to protect myself financially. You probably have very similar considerations. If you're in a position to buy a home from your own capital, then you clearly have assets to protect and I think you are wise to get a prenup. At the time I did my prenup I knew that I intended to buy a house but still didn't have the specific property address available to list in the itemization of assets. So I had the attorney put some general statement in about "real estate property to be bought from funds held in such-and-such account" is also covered by the prenup. It's a bit vague, but the whole issue of enforceablity of prenups is very vague to start with. I see the value of prenup as a kind of worst-case insurance policy: you want to have it, but you hope like heck never to have to rely upon it.

AOS does not require that the name of the beneficiary be "on the house", as you put it. During AOS interview, other papers could suffice as proof that you are married... i.e. marriage certificate, joint bank account, life insurance, letter with both your name, pictures, etc...

I am a realtor - Lars and I bought a house last January (2008) here in Jackson. Since we are not married and he doesn't live here yet, this is how we handled it. The house is in my name right now (we paid cash). I have the deed of trust in my name only. The attorney has prepared a second deed with Lars name on it, attached to my will that spells out exactly what will happen to the house if anything happens to me before we are married. If anything happens to me before he can get back here, the second deed will be filed and the house will be in his name and my will backs that up. Once he is here and we are married we will file a new deed of trust in both of our names.

In Mississippi (and most other states) one person can be the mortgage holder and you can still have the house deeded to two people, even if one is not on the mortgage. You want to hold the property as joint tenants, with full rights of survivorship, which means that if anything happens to either one of you, the house will automatically pass to the other without having to go through the probate process.

For her to legally be able to buy a house, at closing she will need a photo ID, her visa or green card. You do not have to have a social security number to buy a house, nor do you have to be a citizen of the U.S.

I wasn't sure if pre-nups or credit issues were really what the OP was asking about so I left all of that out of my response.
