I am a soldier who had brought his wife to the U.S. I am currently deployed and we are having some problems because

She had arrived 60 days before I had to leave.

I am considering my options. I want to work harder for our marriage but I have been gone almost 10 months.

So, we really did not have a chance to be "live married."

I just trying to understand how would a possible divorce would effect her, if we divorce during this 2 year period.

I have a correction...

I am a soldier who had brought his wife to the U.S. on a K1 visa last year. I am currently deployed and we are having some problems because she is comparing our progress to other people.

She had arrived 60 days before I had to leave.

I had followed my heart in marrying her, but now I am considering my options. I want to work harder for our marriage but I have been gone almost 10 months. I do not know what to expect from her when I return from deployment.

So, we really did not have a chance to be "live married." She had received her GC in November.

I just trying to understand how would a possible divorce would effect her, if we divorce during this 24 month period.

Could she be trying to cook up an abuse situation on me so she will not have to leave right away??

What can she base on to acuse you of abuse?, You say you have been more time away than with her, so I don't see why she can acuse you of been abusive.

If you get divorced then after her conditional permanent residence expires she will have to leave the country.

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

technically speaking, when it comes to immigration processes, since she already have her GC, she can stay in the US as long as it is not expired even if you divorce her, i dont know if she can lift her condition with that status, we just have to wait for other people's input on that,

okay now, regarding your question, how would a possible divorce would effect her, it differs from every person, if me and my husband were in your situation, knowing how i love my husband, oh man, i can't even think about it,

She had received her GC in November.

What can she base on to acuse you of abuse?. Stay calmed and if she keeps trying to provoke you then you will know she is up to something. The good thing is that you are alert!

If you get divorced then after her conditional permanent residence expires she will have to leave the country.

She would not have to leave the US when her 2 year greencard has expired, she can file for the removal of conditions on her own based on the fact she entered the marriage in good faith. If she is divorced before the greencard expires she can file to remove the conditions at that time she does not have to wait for the expiry date. If she is not divorced at the time of expiry then she will need to wait until the divorce is final.

That is not true. If you don't know what you're talking about it's best not to post at all.

TayRivers is correct, your wife will be able to apply to remove the conditions on her Green Card with a waiver and proof that she entered the marriage in good faith. :thumbs:

Is a divorce really the remedy to your problem? Please, try counseling first, I hate to see young couples give up so early on marriage. Marriage is always full of sacrafice, even sometimes sacraficing time from each other for a good cause. Pray together about these issues, dont be too quick to divorce, I'm an ex-soldier (u.s. Army 72-G), Your absence from your wife is to serve this country, it's for a good and honorable cause :pop:

Options? You are jumping the divorce gun a bit too fast, don't you think? How about working on things my friend? I can imagine it is not easy for her, either; to be by herself. It must really svck.

Couldn't agree more. How do you want to work harder for the marriage? By thinking about divorcing?

Since you didn't even have a chance to live a life as a married couple, how can you know if it can work or not?

Does your wife want to leave? I don't envy her for being by herself in a foreign country without any friends and family, and a husband who is thinking about divorce... :huh:

My main reason for the post is to ask simple question about an option. By no means am I giving up without a fight, hard work and some extra tears. I had got married to stay married...to love her and make her feel wanted.

She already has a conditional green card, and divorce doesn't effect her ability to stay in the country. She can remove conditions by herself after divorce, or ask for an extension if divorce in not yet complete.

seek counseling before divorce.
