SAN ANGELO – A woman was charged with aggravated assault with a weapon — her teeth — after allegedly biting off part of her boyfriend's lip in a domestic dispute on Sunday night. Aubrey Joyce Garcia, 27, remained in the Tom Green County Jail on Tuesday with bail set at $30,000. Bradley Miles, her attorney, could not be reached for comment.

Her boyfriend, Antonio Zaragoza, 33, was treated at a hospital and released.

Teeth are considered a weapon because they allegedly were used to disfigure a person, officials said.

If convicted, Garcia faces up to 99 years in prison.

I would have thought that allowing the prosecution to allege that teeth are a weapon is a rather dodgy thing to do. Given the right circumstances, feet and arms finger nails etc are all capable of 'disfigurement' but yet they are not considered weapons yet.

Nor should they be, after all, if we can name body parts as weapons then really, there is no such thing as unarmed. How stupid is that?

I think if you use your Elbows or Knees in fighting it can be a Felony Assault

I am sure there are all kinds of degree of assault, but I am also sure that there has always been a rather large distinction between armed assault and unarmed. Let's blur the lines some more why not?
