I finally got an answer from the Embassy in Dakar Senegal about why they returned my petition to uscis, however they said they had already sent it back. They said my fiance was "not legally free to marry" me. Apparently they contacted the Court in Senegal requested his marriage date not his divorce date. My fiance contacted the Court and they in turn sent a letter to the Embassy saying my fiance is "single" and sent them a new Certificat de Divorce. Also apparently I made some mistakes on my fiance's G325A and had the wrong divorce date and the wrong marriage date. I put the 'religious marriage' date and not the date of the civil marriage which is indicated on the certificat de divorce. Then I put the marriage date as the divorce date. Anyway I really messed up. But you would think that these would be simple enough to correct but the Embassy would not communicate the issues with us and decided to just send it back.

Anyway I contacted USCIS today and they had not received yet. NVC also had not received it yet but told me I could email a supervisor and request an "expedite". I also contacted the State Department Visa Office and they told me to try to contact the chief consular in Dakar and tell him the story and see if they will just give us another interview.

Does anyone have experience with this? how long do you think it may take to get back to Dakar. Any info you can give will be helpful. I will keep you posted about what happens.

If they really already sent it back then you are not getting another interview. They don't always tell the truth. Lagos claimed they had already sent our back within a week of the interview ( mid August) and I managed to find out it didn't leave until the last week of September. The process of it coming back it very very slow and there seems to be a lot of wholes in the tracking of returned petitions.

The civil marriage date is the the one that counts if you have a civil and religious ceremony!

(normally) whatever normal is anymore it can take awhile to get things actually returned, push your new information thru if you can and IF they still have it maybe they will consider but if it is returned its going to take awhile
