Thanks guys to all, but please, there is no point to argue between you. Of course we will visit a lawyer next week, but I just wanted to see where do I "stay" before we visit the lawyer.

I know is is not going to be easy, but also it won't be impossible.

Thanks for all the support, especially to Cino, this is what we need, support. We love each other and even if I was wrong to overstay my visa and work without EAD, at the end it is going to be worth:we found each other and are deeply in love.

I work on a pay roll since May 2007 but as fas as i remember on the SSN statament there are only A few credits. Anyway , we will get a co-sponsor/ sponsor.

I will keep you guys informed about the process.

The bottom line is - no matter for how long you have been on payroll or if you have been paying your taxes and such. If USCIS pays you a visit they will not care about these, they are different government agencies supposed to take care of payroll issues and taxes. USCIS will ask you a simple question: are you authorized to work in US?if you are ready anytime to face this question-good for you. Bit I have to tell you that if they catch you-they will end up deporting you. Also I have seen people being caught working on tourst visa and they got deported, so if I were you I would,t look for similar cases, I would look for a solution.I know it's tough, I'd been there. Good luck!

so what are you actually saying as I will have problems or I won't?

All I can say is working without authorization is very risky. The probability of getting caught off guard might be low, but if it happens-they will send you home.

real question wasn't really that, now I know that it is forgiven upon a marriage to USC, I was simple asking if there is any problem when filing i485, since the info will go on the biometric form G325a but I hear not...

No, there is no problem in that regards. just make sure you list all the places you have been working for. be honest and everything will be ok.

I am surprised at the answers, as none of them hits the nail on the head. Not too much of a surprise, as it is not a situation that comes up often.

When doing the AOS shabang, USCIS wants to make sure that the immigrant won't become a public charge, hence the income requirements.

The O.P. works and pays taxes, using her own SSN. She and her husband need to file taxes jointly as married. If the bottom line is above the required 125% over the proverty line, the requirement is met. It does not matter who's making more as a married couple is a married couple. Do not fall into the trap of comparing this to a new immigrant with no income history in the US and only prospective income. This is real, documented and taxed income of somebody with established work and income history in the US.

The unauthorized employment is a non-issue.

O.P., I did exactly what you did. I worked, paid taxes, and could show that my wife and I were able to meet the income requirements by submitting our past 3 years' worth of tax returns at AOS.

We submitted separate returns for year 1 and 2 (meaning 4 returns), and a joint return for year 3 when we were already married.
