I am not talking about QUARTERS, talking about CREDITS. Comprehender?

YOU ARE SIMPLY WRONG! Quarter Credits , Quarter of coverage... THE SAME THING!

From the SSA website

The amount of earnings required for a quarter of coverage (QC) in 2009 is $1,090. "Quarter of coverage" is a legal term, but you may also see the term "Social Security credit" (or just "credit") used elsewhere. A QC is the basic unit for determining whether a worker is insured under the Social Security program. No matter how high your earnings may be, you can not earn more than 4 QC's in one year.

I have been trying to help OP here. The other people have been so judgemental.

Someone comes up & tells me to shut up basically. That is so rude & unacceptable.

however, does not permit the same reaction to other posters who are simply correcting your information to make it more helpful to the OP..

First of all, I didn't know how long OP has been working? I said if you are qualified then you can file I-864W,

if not qualified you have to find a Co-Sponsor.

I have spoken generally. You don't have to wait for 10 years to be qualified for SS Benefits.

You can be disabled person today (Hope not) & you can be qualified.

Hi to all,

We recently got married, husband is a US citizen, I have been in the USA for over 4 years, I overstayed my J1 visa ( not a 2 year home residency requirement).

I am currently working , I have a SNN, and I am paying taxes. I know, you will say : "what???", well, I needed to make a living .

Now, my husband is currently unemployed and was unemployed in 2008 , too ( he does receive money from his parents, but not a monthly income).

I make over the poverty line/year. Next week we will visit a lawyer also to help us out with he case.

Do we need a co-sponsor since I already make the income? even I am not allow to work? I just want to tell the IO the truth: that I did work during my stay here.

Please do not be mean and judge me, I just want an opinion, personal experience etc.

I appologize if I posted the q in the wrong place, I am new here.

Also, do I need a form or something to go to civil surgeon? Or when shoul I go? We want to file the petition for my status ASAP.

You will be needing a co-sponsor for sure and you can print out the medical forms on the CIS's website.

You should also consider to stop working immediately as you are violating our LAW, do know that there are consequences.

Although I am not happy with what you are doing, I do wish you best of the lucks.

That is the point,

who is USCIS ? That is the government.

Who is SSA ? That is the government too.

Who is IRS ? That is the government too.

Where do you pay your taxes? To the Government.

As long as you pay your taxes, USCIS won't have anything to say.

FYI, IRS has got more power & authority than SSA & USCIS.

Thanks guys to all, but please, there is no point to argue between you. Of course we will visit a lawyer next week, but I just wanted to see where do I "stay" before we visit the lawyer.

I know is is not going to be easy, but also it won't be impossible.

Thanks for all the support, especially to Cino, this is what we need, support. We love each other and even if I was wrong to overstay my visa and work without EAD, at the end it is going to be worth:we found each other and are deeply in love.

I work on a pay roll since May 2007 but as fas as i remember on the SSN statament there are only A few credits. Anyway , we will get a co-sponsor/ sponsor.

I will keep you guys informed about the process.

You do not have to file Affidavit of Support (Exemption of Affidavit of Support / Form I-864W)

if you satisfy the following condition :

<b>"I have earned (or can be credited with) 40 quarters (credits) of coverage under the Social

Security Act (SSA). (Attach SSA earnings statements. Do not count any quarters during

which you received a means-tested public benefit.)"</b>

You must have a SS Statement to prove this which mailed to your address

every year (About 2 months before your BD). If you can not fullfill above condition then you need a Co-sponsor.

It does not matter you have overstayed on your visa (Except some visas you need a waiver) or worked unlawfully

as long as you have been married to USC. These situations are usually overlooked & forgiven by USCIS.

You don't need any form to go to Civil Surgeon. They have all the forms, just make appointment

& show up with the Green.

After you gather your all supporting documents including I-693 (Medical Exam) & of course $1,010 Check,

send all AOS package to Chicago Lockbox.
