Hi to all,

We recently got married, husband is a US citizen, I have been in the USA for over 4 years, I overstayed my J1 visa ( not a 2 year home residency requirement).

I am currently working , I have a SNN, and I am paying taxes. I know, you will say : "what???", well, I needed to make a living .

Now, my husband is currently unemployed and was unemployed in 2008 , too ( he does receive money from his parents, but not a monthly income).

I make over the poverty line/year. Next week we will visit a lawyer also to help us out with he case.

Do we need a co-sponsor since I already make the income? even I am not allow to work? I just want to tell the IO the truth: that I did work during my stay here.

Please do not be mean and judge me, I just want an opinion, personal experience etc.

I appologize if I posted the q in the wrong place, I am new here.

Also, do I need a form or something to go to civil surgeon? Or when shoul I go? We want to file the petition for my status ASAP.

You cannot include your income because it is not "authorized"... if it was you could.

Hi

U CANNOT SPONSOR YOURSELF SINCE UR NOT AUTHORIZED TO WORK, WILL COURSE PROBLEMS TO YOUR APPLICATION, EVEN THOUGH YOU HAVE SSN....STILLL NOT GOOD IDEA...WHAT YOU CAN DO FIND A LAWYER EXPLAIN TO HIM OR HER THE REAL SITUATION. ALSO TRY TO HELP YOUR HUSBAND TO LOOK FOR A JOB. I BELIEVE HE DID FILE TAX THIS YR2008, AND MADE OVER $22,000 DOUBLE CHECK THE YR INCOME COULD B LESS THAN THAT...IF HE DIDN'T MAKE ENOUGH FIND SOMEONE WHO HAVE GC OR USC TO SPONSOR YOU....BUT PLZ DON'T TRY TO SPONSOR URSELF.....ASK LAWYER......GOOD LUCKY ON UR SITUATION....

You can't sponsor yourself. Find a co-sponsor.

I know a man who had worked here illegally went through all this process and got his GC. Good Luck!

Dec 3, 2008 - Aug 20, 2009 (approval on August 7th)

Removing of Conditions

May 9, 2011 - October 4, 2011 (approval on September 28th)

Naturalization

July 19, 2014 - N400 packet sent out

July 21, 2014 - N400 packet delivered

July 23, 2014 - received email/text that I-797 is issued

July 26, 2014 - received I-797 in mail

August 11, 2014 - received the Biometrics notification

August 14, 2014 - biometrics walk-in (original date August 20)

August 18, 2014 - in line for interview scheduling

September 9, 2014 - yellow letter is received (letter is issued September 3)

November 3, 2014 - interview notice is issued (email/text alert)

November 10, 2014 - interview notice received with the interview date of December 11, 2014.

November 10, 2014 - request to reschedule mailed out

December 5, 2014 - interview notice is sent out (email/text alert)

December 11, 2014 - received an interview letter in mail

January 10, 2015 - interview on Saturday at 7am

January 26, 2015 - sent the requested documentation

February 26, 2015 - oath letter is issued (email/text alert)

March 2, 2015 - oath letter is received

March 18, 2015 - oath at 8am

You do not have to file Affidavit of Support (Exemption of Affidavit of Support / Form I-864W)

if you satisfy the following condition :

"I have earned (or can be credited with) 40 quarters (credits) of coverage under the Social

Security Act (SSA). (Attach SSA earnings statements. Do not count any quarters during

which you received a means-tested public benefit.)"

You must have a SS Statement to prove this which mailed to your address

every year (About 2 months before your BD). If you can not fullfill above condition then you need a Co-sponsor.

It does not matter you have overstayed on your visa (Except some visas you need a waiver) or worked unlawfully

as long as you have been married to USC. These situations are usually overlooked & forgiven by USCIS.

You don't need any form to go to Civil Surgeon. They have all the forms, just make appointment

& show up with the Green.

After you gather your all supporting documents including I-693 (Medical Exam) & of course $1,010 Check,

send all AOS package to Chicago Lockbox.

I do not want to encourage any people out there , but it is the truth.

As long as she has paid taxes & does not owe any back taxes to IRS, she is going to be fine.

Believe me, I know what I am talking about, I did not come to this country yesterday.

And btw, nothing personal but never Sheesh me again please !......

I do not know what your experience is; but telling someone to use illegal income to substantiate/sponsor a legal petition is worrisome, to say the least. It is encouraging to do things the wrong way.

I would be less carefree telling people to do stuff like this. The law is there for a reason.Does it svck sometimes? Yes indeed. Do people get away with breaking it? Absolutely. But this is not what VJ is about.

While this is interesting information... the OP has only been here 4 years.... 40 quarters is the equivalent of 10 years.... (40/4 = 10)

FYI, one credit means $1,050 of earned wages. So it does not go just quartes only whichever is satisfied first.

It means if OP has already made 42,000 so far, then she is qualified.

I don't want to lecture about SSA, this is not our subject. Is it clear now ?

I don't know if this is relevant or not, but if you have a ssn and have been working and paying taxes then won't the USCIS know that? It's all linked to the ssn which you put on the forms.

How are you working legally? My husband is on an O1 visa and we listed our joint income.

I would seek a good immigration lawyer.

FYI, you can NEVER earn more than 4 quarters a year regardless of what you make... If you earn 4,100 or 180,000 in one year it is still ONLY 4 QUARTERS

That is the point,

who is USCIS ? That is the government.

Who is SSA ? That is the government too.

Who is IRS ? That is the government too.

Where do you pay your taxes? To the Government.

As long as you pay your taxes, USCIS won't have anything to say.

FYI, IRS has got more power & authority than SSA & USCIS.
