Getting ready for my I-864 and am getting slightly (OK, Very) confused as to the different type of sponsers. I am trying to see all options I may have. For starters I understand I need to file the I-864 for me, the petitioner/sponser. I am worried about my self employment income (expect about $30,000 this year), due to possible lack of proof. My parents owe me $50,000 which I will recieve when a house they have for sale sells. Their other house, in which they live, is my address. That is where me and my wife intend to live.

1st) Though there will be four of us in the same house I would only need to support me and my wife if I am the only sponser and therefore claim only the 2 of us on I-864? Correct?

2nd) If I have my dad sponser as a joint sponser the number of people would change to 4 on his I-864A and my I-864 (my mom, dad, wife, and me)? Correct. Of course now I/we would need to show above 125% poverty for 4 people, right? As a joint sponser my dad's pension, he's retired, would be added to my income showing us together make about 60,000 per year(a guess), Right. His assets (that house in which I'm owed 50,000) and my mutual funds, etc... would also be added together, therefore this is a way for me to include that 50,000. Am I going off track or do I understand this correctly?

3rd) If I have my dad Co-sponser me do I understand correctly that his income and assets are what is to be counted and not mine. Basically I mention and list my income on my I-864 but they will only be interested in his. And what he draws from retirement and recieves as his pension better be above 125% poverty for 4 people because we would all be under one roof, Correct? So he would have to include that other house under his assets.

If I understand correctly the best path might be to use him as a joint sponser so our income together should take me well into the safe zone. Especially with assets listed. Of course if the house sells I would have that money and I probably wouldn't have to use him.

Hopefully they would agree to whatever I need as they like my wife and my mom immigrated from Norway 50 years earlier so she understands the responsibility.

A quick reply:

You will ALWAYS be the primary sponsor and MUST submit an I-864; whether you have enough income or not. No way out of this one. You should have enough income for both you and your spouse. Check poverty guidelines :guides:

If your dad agrees to co-sponsor; he then submits ANOTHER I-864. AND if he is using someone else's income (say, your mom's) he will then fill out an I-864A.

Wait -

How much did you make last year? You should have tax returns. Was it more than $18,212. (2 people)

Do you have a current commercial rating concern? Bank statements showing money going/out of your bank account (deposits/withdrawals)?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
