here is what it means.. it means she is "ineligible" for a visa.. the I-601s are given to people who were put on a ban and have been to the US before, but got removed or deported (from visajourney AP forum).. the thing is she has NEVER been to the US before.. so what the #### is going on?? :angry: :angry: I'm calling DOS a 4th time now and giving them a piece of my mind.. this is stupid..

i mean why u need to ? if its a mistake then call DOS and Email or call the embassy to clear that this is a mistake

if its not then FILE a waiver as soon as it can be and follow the procedure please ...

Morning everyone. Hey Courtney is it just MY mena guy or do they seem to not like much color on the walls?? My husband's family's aparment is ALL off-white. He of course has seen my bedroom on webcam which happens to be a chocolate brown. It looks great cause my room is huge with tray ceiling. He said, "it is not suitable color for bedroom". So I would like to paint it before he gets here but it was a b*tch to paint cause of the ceiling.Sigh....

How about a lighter color? Maybe he just doesn't like the bold, dark colors. My MENA husband says do as you wish...so i gave him the option of green or purple, he chose dark purple...

Mohand will faint when he see our bedrom it is 100% girlie, curtains, comforter, wallpaper, stenciling, frilly, lace, the whole 9 yards. LOL

Wall paper is floral, has some purple, pink and yellow in it,, curtains are a med purple, and comforter pillow sham and etc matches the wallpaper.

I asked my dad if we could paint my room different color but he said the weather is too hot, if we put darker shade it will be way too hot and stuffy.

that's his take on the off-white walls. sometimes we put in a tint of blue... barely discernable but mostly every time we paint the house it's in white.

What's going on? Maybe she was asked a question and the consul got confused with her answer??? I don't know.. not here to judge.

Can you find out why they think she's been to the US?

Glad to hear about your new washer and dryer. I have front loaders. You are gonna LOVE THEM!!! So anything new going on today?? As for the flaming this weekend, well I have to confess I participated. Sometimes the arrogance of some of these folks makes me angry. But oh well you can't change them so why bother. It is raining here AGAIN. Noah, get the ark ready!!

gogo what is going on this is becoming to be unbelievable what you have gone through and continue to go through. It would seem to me that there is a huge mistake here. From your posts they are asking for a waiver due to the fact that your wife was in the US previously and had to leave, being under some form of deportation? My goodness what you must be going through, I feel so so sorry for you and your situation.

Do you think that they have got your wife's name mixed up with someone who was in fact deported or under similar proceedings? It would appear that every time you get over one hurdle an even bigger one appears.

Please keep us informed of your progress. Perhaps you need a good attorney to sort this out. We wish you the very best.

Hi Arthur Roberta.. yes, we have supposedly a good lawyer (or a team).. that's why I went with a team so they can discuss more with each other..

well, I just called the DOS this morning.. about 4 times to confirm.. hehe.. 4 different people say the same thing.. after a little pushing out of 3 people.. originally they just said I was under AP.. but I said that I knew about the waiver.. then they say : "oh yes, you do have one.. it says it in the notes".. So I just did some research this morning on the I-601 (and I-212.. at first couldn't figure out).. found out they issue this after denial and also if the person overstayed, deported, or got removed from the US (she has never been to the US before, so #######??).. I called the lawyer, and we had a 10 min discussion on what to do.. they figure we do either one of two things : 1) send a FOIA request for her (not me), that will take lots of months to many years.. because the FOIA request is not on me.. then they know exactly what to fight against.. 2) wait for the official notice, send in the I-601, and send in a "extreme hardship" letter.. I can probably do a couple there ("financial, educational, personal" - leaving parents, lose job, and lose education).. but they say it will be a uphill battle because normally the I-601s are used in deporting, removing and that the beneficiary was ALREADY HERE in the US.. they just got removed because the US told them to.. that will benefit "extreme hardship" for both sides.. but now the lawyer said it is only hardship on my side.. :crying: :crying:

This is a weird one, for you are unable to answer the reason for the I-601 because they are not furnishing the facts behind the denial. I am really puzzled here because this would appear to be a determined act to prevent the issue of a visa. The FOIA can be expedited in your situation but as for the time frame of an expedited FOIA request I do not know. As for the filing of hardship that is extremely difficult to obtain especially you the petitioner have no form of extreme hardship should your wife not be granted a visa.

I am at a loss here and as all this is shrouded in the need to know scenario, are you ever going to get to the bottom of this? Something somewhere is not right. I would tend to think that there has been a mix up whereby they have got information on someone similar to your wife who was in removal/deportation or similar circumstances.

As for the team you have engaged in this situation they do not seem to be coming up with much more than what you could have obtained here. Surely there is a method by which you can obtain the truth of the situation...some mechanism to help you?

I sincerely hope there is an answer to enable you to move forward.
