Hi,

I am a bit confused. Again.

My wife has entered on her K-3 Visa and applied for her EAD, which was approved on April 12th but she needs to do her biometrics (we are still waiting for and appointment).

1. Does it usually take this long?

2. Can she get a social security number with this?

3. If not, can she work?

AND

We have been reading through all of the requirements on the AOS, and it just seems redundent. Does she really have to do another medical exam? And should it really cost $480? Do I need to do another affidavid of support? Don't they have copies from the port of entry when we handed it all in?

We have been approved for the I-130 here, does that mean that it has been sent on to the embassy in her home country? And, if so, then could we just not file for a AOS and return to her home and have the interview for the IR-1/CR-1??

Can someone please help me?

Each is a separate process so yes all needs to be redone for AOS. Just as medical etc would need to be redone for a CR-1 visa. As for the affidavit of support, you would of supplied an I-134 for a K-3 visa where as the I-864 is required for AOS.

If you have an approved I-130 it still needs to go through the NVC process (See NVC Flowchart) before being sent onto the consulate for the CR-1 interview. The NVC process can take approx. 2-3 months depending on a if one uses the Shortcuts and on getting a clear run, no hold ups with security checks. If you are wishing to do this you do not do AOS in the US from the K-3. What you need to look at is the time frame on average it is taking to do AOS through the 'local office' that you will go through and make a decision accordingly. To me AOS seemed an absolute pain in the butt compared to doing the CR-1.

Good Luck, I also came here on a K3 then returned to London for my CR1 interview, :thumbs::yes:

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

if she returns to UK for the CR1 interview I believe she will need to do the medical again. But if she does AOS in the States and her K3 medical was less than a year before you send in the application, she will not need another medical.

If you decide on AOS you will need to notify NVC of this so they can forward your I-130 to the appropriate district office.

She can get her SSN once she has the EAD card in hand yes. She cannot work until she has the EAD and SSN.

Also if she returns to the UK for the CR1 interview, & the medical from the K3 is less than a year old she also wont need to have another :thumbs:

I'm sorry, but I can not understand how someone could come this far in the process without having a clue about the next step, or seemingly, what the end goal is.

californiabound: in 6 months at visajourney, have you NOT looked at any of the info in the blue tabs at the top of the page?

If I had your wife's email address, I'd forward the information to her. She's the outsider here; she should at least have an idea of what SHE needs to do to be legal in the US.
