Petition Denied:Decision for Appeal in 2weeks

Hello Everyone,

Our petition for fiance visa K1 was denied month of February because we failed to establish evidence that the two of us have met within 2 years then sent an appeal i-290b. Fiance received a hard copy of notice that our appeal is under process and review.

My fiance was happy to inform me that he spoke to an agent from USCIS to follow up the status of our appeal that decision will be granted in 2weeks though is not yet the good news that we have been waiting for almost 10months, still praying hard that it will be what we wish for.

01/05/10 - Visa on Hand

01/16/10 - POE Seattle Tacoma airport, WA

02/03/10 - Received SSN

03/09/10 - 2nd year Anniversary

04/12/10 - AOS, EAD, AP Application Submitted

04/14/10 - USCIS received package(AOS application)

04/22/10 - got email notification receipt number

04/24/10 - Received hard copy I-797 notice of action (AOS, EAD, AP)

04/30/10 - Biometrics notice thru mail

05/11/10 - Biometrics Appointment

Sorry to hear that mayalar. Maybe the councilor that interview you was just in the bad mood on that time or what :unsure: (joke). When i had my interview also in my K-1 before i dont also have enough proof that we met exactly within 2 years prior of my husband now coz we dont reach the 2 years yet before we filled the petition on that time. I was very nervous when they asked me if how and when we met but i told them the truth coz i cant lie and making up irrelevant dates if how and when we met coz they have the copies of my husband passport if when his first visit in philippines to see me and dates of our communication through mails and phone bills lol. So maybe we just got lucky :unsure: .. but was waited almost 1 month before i recieved my visa.

I know its hard to think positive when your still in that situation but i still say....THINK POSITIVE lol. It's under review now again maybe it will be a good news this time.

Do you have passport with country stamp in it, showing entry and departure into the country?

I think that is more solid evidence than even a boarding pass. The hotel receipt with the petitioner's name on it and address of hotel should be good.

Can you post the exact wording of the denial?

I am concerned, did you give them the exact same evidence you provided in the first place? Unless something was missing from the initial submission or you added more, that might not work. (if they made the decision based on the same thing you initially sent, they will do it again)

He should send a complete copy of his passport, with stamps, showing the timing.

Let's look at the evidence you sent:

Boarding pass This is good, but by itself, needs a bit more to show he was actually there.

Hotel receipts This is good, but does it have proof of his ID on them? (like credit card, etc..) - then again, anyone could use his credit card without him being there.

Record of phone call first day from the Manila hotel for our first meeting Anyone can make a phone call, doesn't have to be him

Iterinary Anyone can make one of these, doesn't mean you actually did it.

The passport would tie the evidence you have together.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I remember he used his visa card (Bank of America) as payment in Manila Hotel.

Denial reason was Failed to establish evidence that the two of us have met within two years...

My fiance sent copy of our pictures together on initial evidence sent , provided passport number and details about his visit....but wasn't aware the need to provide a hard copy...

My fiance sent copy of our pictures together on initial evidence sent , provided passport number and details about his visit....but wasn't aware the need to provide a hard copy...

If he has his passport with the entry and departure stamps showing he entered and left your country on the dates you specified, then he should make a copy of his entire passport including front and back cover and including blank pages and send that to the embassy. Quick before they decide again.

If he doesn't have that, you may have to remeet again and start all over again. Sorry.
