Hi all,

I originally filed for the K3 visa, but at the time of interview my wife's I-130 petition was approved. So, wife called me and said she is getting a CR-1 visa. But when she arrived here, I saw they granted her an IR-1 visa. But the only thing is that, we got married may 2008. And from what I read about IR-1, it is given to beneficiaries who have been married for than two years. Is that correct?

Was the wrong visa issued by the Embassy to my wife?

Also on her Visa above the two lines that the reader uses there is... "Upon Endorsement Serves as Temporary I-551 Evidencing Permanent Residence for 1 Year".... What does this mean?

Another thing concerned me is "IV Expires On: 22OCT2009" Only six month after it is issued "23APR2009"? Isn't is supposed to expire in 10 years for IR-1? Or even CR-1, two years?

That is strange that your wife got the IR-1, as you said it should have been the CR-1. You are probably just lucky, but I'd check via an infopass appointment if everything is ok, just so you don;t fail to remove conditions in two years and she becomes illegal by mistake!

The sentence you see means that the visa in her passport serves as a temporary green card, until she gets the actual plastic green card (this can take several months, see my timeline). So that sentence will allow her to work and do other things legal permanent residence are allowed to do.

You don't have to worry about the expiry anymore; that means that you have 6 months to use the visa, ie immigrate into the US. As your wife is now here, she has fullfilled the terms of her visa and is a legal permanent resident (green card holder).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It's really up to them to decide what type of visa she should've received. If the embassy gave her an IR-1 visa, the Immigration officers at POE may catch it and fix it to make it a CR1, or the USCIS may catch the error while entering her info in the system and mail her the CR1 green card which is only valid for two years. If she does end up getting her 10 year card just give the USCIS a call to find out if it is indeed valid for 10 and not 2. If they say it's ok, then celebrate. They make mistakes all the time so it's not out of the ordinary. ^_^
