Hi guys, I'm not sure what forum to post this in so I will put it in here and the regional forum.

First off, I have filed for the IR-1 visa for my wife who is currently in the Philippines.

I am currently working on getting my documents together for the next leg of the journey, the NVC.

I have become stuck on what to do about the affidavit of support. Here is my bare bones, unvarnished situation. I am 32 years old, have a bachelor's degree, but have been living off an inheritance for the last decade or so, so my income has been pretty low unfortunately. Thankfully, after becoming engaged last year, I came back in August of 2008 and started working at a job earning 25k a year, more than enough to pass the 125% requirement. At the beginning of this year, I went and married my then fiance, and when I returned I was told that the economy had hit my company I was working for pretty hard and they told me to take a month off. So I had hopes of returning, but now it has been two months now and no phone call, so I have been putting in applications like crazy for the past 4 weeks. I have some prospects, but the only sure job offer I have is for a local retail store earning whopping 7.20 and hour. I am going to take it because I need income right now and have no choice, but will continue to apply and interview in the meantime.

So here is where I am right now. I have 7k cash saved in the bank, no IRA, no Stocks or bonds. Current income will be 15k a year unless I can find a better job soon. Last years w-2 showed 9009.00 income, and 2008 tax return showed AGI of 10750.00 (I had some interest income on cashed in bonds)

I can use my mom as a co-sponsor who makes far above the poverty line, has a paid off house etc, but if I can do it on my own, I would prefer that. Also another possible option is I have wealthy aunt who knows my situation and has offered to flat out give gift me about 15,000 dollars to help me meet the support requirements. Also I have all my old pay stubs from the past 6 months I was employed up until I was essentially laid off.

Recap:

IR-1/I-130 filed for my wife in the Philippines.

32 years old

Wife has no income of her own yet, she hopes to attend college to earn an education degree.

$10750.00 AGI in 2008

7k in Cash in the bank with possibility of 22-23k in the bank (This would be 3x the difference between my 2008 AGI and the 125% of the poverty level)

Current employment starting tomorrow earning 15k a year.

Paystubs from Aug 08 to Feb 09 showing income of 25k a year.

Co-sponsor willing to help.

Potential for a 30k+ a year job using my bachelors soon as I can land a job in the area.

Potential for my 25K a year job to bring me back, but looking unlikely for the next few months.

Given this situation, what is my best option?

Using the co-sponsor on your I-864 appears to be your best option.

Okay, I will look into getting all the paperwork for a co-sponsor going. Will sending in co-sponsor information, even if I can meet the requirements on my own (assets+income), be okay? I.e. playing it better safe than sorry since it is close?

Also, out of curiosity, what is the process if someone gets denied on the basis of the support requirements and has no co-sponsor? Can they put the application on hold while the petitioner scrapes together some resources, or gets a new job, or do they have to start all over from scratch?
