I94 valid for two years????

Timeline

Hello, I just wanted to find something out my wife came to the states on a k3 visa and she got a two years visa "I94" now my question is do i have to apply for her green card right away i know i can do it anytime but is their any rule where i have to apply for the green card within 3 months or ASAP or can i do it a few months later like after 6 months or so. she has a visa till 2011.

you can do it anytime up to the I-94 expiration date.... so you can wait

To preserve her full ability to enter and exit the US, you'll want to complete, not just start, the AOS process before her I-94 expiration date. Additionally, if you file AOS more than a year after her K3 medical exam, you'll need to pay for another exam before filing. Otherwise, as long as there's no immediate or pressing need for work authorization, completing AOS after the two-year anniversary of your marriage will result in a 10 year green card and avoid removal of conditions.

HI Pshbrk, I have a K-3 visa also and im planning to file for my AOS before dec 21, 2009 for our 2nd wedding anniversary, now my question is my medical will be expire this coming July 3rd do you think if i'm going to file my AOS before my medical expires its possible that the approval after my 2nd wedding anniversary and have the 10 years GC?

EAD APPLICATION:

2009-01-10 ----- E-filed EAD Application

2009-01-20 ------NOA1 Receipt Notice

2009-01-22 ------Biometrics appointment recieved by mail

2009-02-11-------Biometrics Date (done smoothly)

2009-4-15 -------- EAD Approved

2009-4-24 -------- EAD Received by mail ( yyyeeeeessssss)

It's possible but only if the status is granted after the two-year anniversary. How long it takes from filing to interview depends on the local office.

If I am not mistaken, if the I-94 deadline is approaching and the AOS process is not yet complete, the adjustment applicant/visa holder can request an extension of the visa, which would be interesting if one were planning on travelling at that time. (extension of visa might not be correct terminology.)

However, it is an additional cost of $300+ and may take a while to process, so don't make any specific travel plans for after the K3 expiration until you have either your green card, or extension approval in hand.
