Missed the interview and havent' done anything abt. it for 2 years

Hello,

My brother was scheduled for his citizenship interview but he didn't bother to show up. That was in 2006 and he hasn't done anything with it up to now. Now he wants to get his citizenship. Does he just apply again like he did the first time or is there another process for people in his situation? Is this even doable? His foreign passport and U.S. green card has expired since. Is that a problem? Thanks in advance!

As far as I can tell - in the eyes of the US Government - he has abandoned both his citizenship application and his permanent resident status. Not sure how long ago his PR/Green Card expired, but he is in overstay status as of that expiration date. As the saying goes - he is between a rock and a hard place.

Well, you can't apply for a naturalization without a valid green card so the first step is to get one.

So, he should first apply to get a new and valid card.

He might have to pay a fine for letting the old card expire and not renewing it, i am not sure as I am not a lawyer. Legally, you are under the obligation to always carry with you a valid card. If they refuse renewing the card I would consult with a lawyer ASAP, because at this stage I am not sure your brother should even be in the US.

Also he should get a valid passport from his country of origin.

Second, I would file a new N400 with all the documentation and one of the questions is : have you ever applied for citizenship? he should answer yes and provide an explanation with what exactly happened. Then he waits for the USCIS answer. He has a problem he should consult with a lawyer. In any case he should never lie to an immigration inspector.

A LPR does not loose status when the card expires, however will need to file an I-90 to renew the green-card.

As for the abandoned N-400 process, more than likely will need to file another N-400, bummer the rates went up July 2007 so will have to spend MORE $$$ to apply for citizenship.

I would also recommend that once he has received his new passport and if he is still waiting for the new card, to go to the ACS to get his passport stamped.

In the meantime, I would avoid any international travel has his entry into the US might be delayed at the port of entry.

His greencard expired in 2006. Is it okay/feasible to reapply for another one?

I don't mean to be intrusive, but why didn't your brother show up for the interview? And why didn't he renew his green card?

I'm one of the many people in this forum who is obsessed with our immigration journey, so what appears to be your brother's disinterest to it is mind-boggling for me.

I'm sure there's a very good reason for it. After all, he did take the time to fill out the application, have pictures taken, and pay the fees, right?

It is MORE THAN OK to renew his greencard! He will not get in trouble if that's what you mean. I got my greencard as a BABY and didn't renew it until last year because it didn't even have an expire date.

Bottomline, have him do an I-90.
