I was given an RFE at our interview to bring in the divorce decree plus translation. Or it said, if that is unavailable the extract from your country's registry of births, deaths and marriages. They gave me 30 days.

But since the divorce decree had to be requested by mail, I was unable to get that within the 30 days, even though I had requested it. So I brought in the extract from the registry with translation PLUS a scanned/printed copy of the divorce decree and its translation.

The 30 days have now passed and I received the original divorce decree. Should I still go bring it in???? Or is it too late for that? Because it did say on the letter, bring everything together. So I don't want to confuse them and get denied for something stupid like that. But I'm not sure if what I brought in is sufficient.

Also, on my registry in Belgium, my status is "single", because since we got married I have not been able to go to Belgium or to the consulate to change my marital status. Does that make sense? Or do you think that might confuse them?

I brought in my response to RFE exactly 2 weeks ago, and I haven't received anything yet, my status online has never been updated since January, which is before the interview. If they accept my response to the RFE, when can I expect the green card or welcome letter in the mail?????

Thanks so much, I really need your thoughts!

Call and find out the status of your RFE/case - if they didn't accept it, or didn't get your info, they will consider your case abandoned.

Don't wait for something to happen, make it happen :)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I would call the local office - you can call information to get the number I would think.

Didn't the interviewer give you any contact info?

Did you notify your local office that it would take you longer than 30 days to assemble the information requested of you? It sounds like you did not, but I just want to make sure. If you do not respond to RFE's within the time frame allowed, USCIS could consider your case abandoned and deny you based on that fact. You need to make an INFOPASS appointment as soon as possible to see what the status of your case is.

Make and appointment and go talk to someone at your local office.

I see...you satisfied the RFE then...you should be fine. The RFE wanted a copy of your divorce decree (w/ translation) or a copy of what your country's civil registry has listed for you. So you sent in something...it is now just a matter of them processing it, which may take a bit longer. Unfortunately there is no time frame for when your green-card will come, but I've seen that after a successful interview(where no RFE is issued like in your case) it is usually stated that the green-card will follow in the mail in 4-6 weeks. You can use that as a guide for your waiting time.

FWIW, I think the fact that the civil registry record states that you're 'single' is exactly what they're looking for...given that they're requesting a copy of your divorce decree. They want to see that there was complete dissolution of your first marriage in order for you to have been free to marry this second time.

So this extra info you wanted to bring them...is this information required by the RFE or stuff you just wanted to show them to make your case in a more convincing fashion?

Your marital status in Belgium will not matter. Whether you ever change it is up to you.

It sounds like you responded to the RFE in the manner requested, it was "either/or" and you gave them "or", correct? I think you are fine. If you decide to send anything else (which couldn't hurt) be sure to send COPIES and send a copy of the RFE letter so they know which case it goes to.

I cannot guess when they will process the green card for you.

Okay, I was given a paper with several points on, only number 4 was checked. This is what it says:

Furnish proof of death or legal termination of marriage of the beneficiary. PLEASE SUBMIT A COPY OF YOUR ANNULMENT/DIVORCE DECREE FROM YOUR FIRST HUSBAND. IF THIS IS NOT AVAILABLE, PLEASE SUBMIT A COPY OF YOUR REGISTRY WITH TRANSLATION.

The letter also clearly says, bring everything within the 30 days. And it also says, submit all evidence at one time.

So I was unable to get the original divorce decree in my hands WITHIN 30 days, so I brought her a copy of the registry with translation, and I also brought her a copy (not original, it was scanned and send thru email to me), of my divorce decree plus translation. I did this before the 30 days were passed.

The 30 days now have passed and I finally have the original divorce decree in my hand. So I am playing with the thought of bringing it to the USCIS or not, since it says "submit all evidence at one time". What do you thing????

Also, on the paper, number 5 says: "If the civil document is unavailable, you must obtain a letter from the appropriate civil authorities certifying that the document is not available...." But that number was NOT checked. Only number 4 was. So I assume that doesn't pertain to me, right????

I'm just going crazy thinking about this.... I am so ready to close this chapter.
