Hey Guys,

You have seen my previous postings about my case status,

Aplied for K1 visa 2 years ago,

Fianace on Ap for 9 months now,

please tell me what you think about the following?

I am thinking to file a law suit with the help of my attorney,

i spoke with different lawyers, and basically got so many different answers,

1-my question is if i go ahead with the lawsuit what is the chance of my case being processed faster?

2-if i am not winning the case in court, will they deny my case basically for the reason i sue the government or they say wait until my turn comes,

3-if i loose the case, can i get married and file under K3?

Please advies, and thank so much for your response.

When you file the WOM you are making the government give you a decision of yes or no. They will answer you and if the security checks are not completed it means the decision is s a denial. You should let them finalize the checks on your finance since her job, travels, and nationality all are playing a part in the AP.

If you so call win the case in court the decision may not be favorable to you. Your AP is having to deal with security checks and it is not an issue of them dragging their feet on your case.

3-if i loose the case, can i get married and file under K3?

If you lose then you can reapply for the K-3. Just be aware that what security checks that are taking so long this time will also be the same problem with the K-3.

Filing a court case could take years before you get a decision and it may just tie your case up in a legal void until then. I'm sorry it's so long but I think waiting this process out may be best, then if you see fit file then.

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen

i spoke with three different attorney's in Washington D.C where i live, they told me it takes three to four months to go to court. my chance of getting the case to expedite my fiance's case is only 50%. but i am not sure if this is the case. IS IT REALLY TAKING THAT LONG Maybe one year to go to court?

Filing a court case could take years before you get a decision and it may just tie your case up in a legal void until then. I'm sorry it's so long but I think waiting this process out may be best, then if you see fit file then.

9 months of AP is not out of the norm lately. An attorney who takes your case to court after less than 18 months is after your money. Most attorneys I've read about won't even think about until 2 yrs or greater. On the up side, 13 months seems the high side of average for AP, and in reality it could end any day. . .some people's AP here take 10 days, six months, seven months then it usually ups to 12-13 months. . .above that is not as common, but does happen.
