Hello,

I was just wondering how many pay stubs my husband needs to submit with our AOS application? I was trying to read about it on the USCIS but they say it's optional if you think it will help.

We are planning on sending in his 2005 tax return, a letter from the bank, and a letter from his employer.

How many pay stubs did other people send in and did you receive an RFE for more?

I hope the letter of employment will be enough. I have one paystub from my full time job but I won't have a pay stub from my part time job til school starts back in August, even though I'll have a letter of employment from the part time job well before that time.

What do y'all think...if I file AOS with only letters of employment?

We didn't include Pay stubs on my AOS package just 3 yrs.taxes & work contract . I didn't got RFE but we'll bring the pay stubs during the interview in case they asked

I sent four months of pay stubs and three years of taxes- mainly because although my income the previous 2 years was above the poverty limit and my income now is above the poverty limit, because I was in the UK for 2005 my 2005 taxes show only $4000 in income. I also sent copies of my UK visas to show I was legally residing in the UK during that tax time frame. I have a co- sponsor on standbye because I know for sure I'll get an RFE anyway.

7/6/09: NOA1

7/24/09: Biometrics

10/08/09: Interview

11/21/09: Receive oath date

01/22/10: Oath Date

2 paystubs - didn't have more. They are direct deposit confirmations, and the latest one reflects salary up to that point. Also, 3 x(fed. tax +w2) + employer letter.

Anyways, USCIS just revised I-864 form, it also posted a link describing simplified I-864 procedures http://www.uscis.gov/graphics/publicaffair...pp_062106FS.pdf. They will be effective July 21, 2006.

My husband put 2 paystubs on AOS since he got raised beginning of this year.

The pay stubs showed we have more income than annual report (he made more than 125%, though).

Well as per the revised I864 it says last 6 months pay stubs

so it means if US spouse is paid biwkly then do we have to put in 12 pay stubs???

Thanks for your help! I think we should be ok with just 1-2 pay stubs considering the new rule. I read the link and it states

"Each sponsor is now required to submit as initial evidence only his or her single most recent tax return rather than tax returns from the three most recent federal tax returns, pay stubs covering the most recent six months, and an employer letter"

So what I am thinking is we submit the last 3 tax returns, 2 pay stubs, employer letter and bank statement, we should be good because it states that even if you apply before July 21st the new rules apply. Therefore, we will be including more than necessary if I read that right.

I will tell my husband and my co sponsor to keep ALL their paystubs till the interview just in case too.

Another question I have after reading that....if we apply before July 21st should we be using the new I-864W form??? It just says that these forms will be available online.
