The 134 is optional in Mexico. If you make enough to meet the poverty line at 125% with your past years taxes then you don't have to send any bank statements at all. They don't care wether you send the turbo tax printouts or the IRS tax transcripts, so just do whatever is easiest for you.

I'm trying to pull everything together so that my fiance can go to his open appointment sometime in May. I have a couple of questions about the I-134...

1. I had my bank write a letter, but it only states when my account was opened, my average collected balance for the past year and my current balance. I know they are looking for the total amount deposited, but they wouldn't do that for me. If I include bank statements from the last year, does it have to be the complete statement, or just the first page that's a summary? Should I go through and add up the total deposits myself and attach a separate letter of my own?

2. What are tax transcripts? I've filed with TurboTax online for the last three years, can I print something from there and include a copy of my W-2's? I know I can request them for free from the IRS, but don't want to wait much longer to get this all sent off to my fiance.

3. Can all the documents I send be copies, or do they need to be originals (W-2's, pay stubs, bank statements)

4. I'm sure that my fiance's employer would hire him back, would there be any benefit to getting a letter from them?

5. What do I say for question 11. Do I intend or not intend to make specific contributions to support the person....? Of course I intend, he's going to be my husband!

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)

Optional for Mexico??? I never heard that before! Yes, I am above the 125% poverty line. I just requested IRS transcripts, but it said it would take 10-15 business days for me to receive them. I want to get all this down to my fiance before that, so I'll do the turbo tax printouts.

Per form I-9, employers are now required to verify EAD, and are required to look for an EAD Photo ID Card.

K-1 is NOT A WORK VISA. It is a fiancee visa for the purpose of entry to the USA and marriage. SSA has been told by USCIS to treat the K-1 as work auth so that they can justify issuing a SSN, which in some states is REQUIRED in order to get a marriage license.

Good question, I am wondering if it needs to be notarized as well.

yeah I have read on here where is not needed if make enough and someone else has

said there is no place to notarize. I have sent my fiancee one without, but now am

wanting to make sure before interview. Plus if things need to be official then they

should request notarize on all forms, right? so I figure is not needed. But will like

input on, especially those that were required to have.

Good question, I am wondering if it needs to be notarized as well.

The new I-134 has the same wording as I-864 near signature block, and NO place for a notary. Please read the form's directions, NO NOTARY NEEDED. By signing the form you are swearing under penalty of perjury that the I-134 and attached docs are true and accurate.

The directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq/0,,id=199557,00.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

The I-134 is very clear! "Total amount deposited for the past year" If I was you I would take your I-134 info page and show them (bank) what needs to be done, my bank charged me $5.00 but I got it as for your tax trans call IRS I think you can have then FAX IT TO YOU.

For the people talking about the Phillipines, I'm not sure of the requirements. I think the Phillipines tends to be very strict.

It doesn't even mention the I-134. It only says you "may" choose to submit ANY of the following:

PETITIONER’S / APPLICANT’S OWN FUNDS The petitioner/applicant who expects to be able to meet the public charge provisions of the law through personal financial resources may submit to the consular evidence of funds or income from one or more of the following sources:

1. Statement from a senior officer of a bank showing present balance of petitioner’s / applicant’s account, date account was opened, the number and amount of deposits and withdrawals during the past 12 months, and the average balance during the year (if there have been recent unusually large deposits, an explanation therefore should be given);

2. Proof of ownership of property or real state, in the form of a title, deed or the equivalent, and a letter from a lawyer, banker or responsible real estate agent showing its present valuation (any mortgages or loans against the property must be stated);

3. Letter or letters verifying ownership of stocks and bonds, with present market value or expected earnings indicated;

4. Statement from insurance company showing policies held and present cash surrender value;

5. Proof of income from business investments or other sources.

If the financial resources are derived from a source outside the United States, a statement as to how the funds or income are to be transferred to the U.S. must be provided.

I sent copies of taxes with w-2's, and they were fine with that. So don't worry about the bank or the tax transcripts.

if memory serves, we asked this at an infopass appt last year and you can put N/A as that question doesn't really pertain to K1s.

Shoot! I forgot to bookmark the USCIS page, but... EAD stamps on I-94s are *specifically noted* as remaining as valid proof in the April 2009 changes to I-9 requirements. Sooo, sorry, but the above statement is only partially correct.

As per the confusion between USCIS vs SSA stated requirements, the SSA clearly states that a K-1 (along with a number of other visa types) are very specifically authorized as acceptable for proof of employ ability by US employers (at their option) as of THIS MONTH. The previously cited USCIS document that states otherwise is dated Jan 2006. So.......??????? ..... WTH is the actual policy, I'd like to know (from an official source!)
