I'm trying to pull everything together so that my fiance can go to his open appointment sometime in May. I have a couple of questions about the I-134...

1. I had my bank write a letter, but it only states when my account was opened, my average collected balance for the past year and my current balance. I know they are looking for the total amount deposited, but they wouldn't do that for me. If I include bank statements from the last year, does it have to be the complete statement, or just the first page that's a summary? Should I go through and add up the total deposits myself and attach a separate letter of my own?

2. What are tax transcripts? I've filed with TurboTax online for the last three years, can I print something from there and include a copy of my W-2's? I know I can request them for free from the IRS, but don't want to wait much longer to get this all sent off to my fiance.

3. Can all the documents I send be copies, or do they need to be originals (W-2's, pay stubs, bank statements)

4. I'm sure that my fiance's employer would hire him back, would there be any benefit to getting a letter from them?

5. What do I say for question 11. Do I intend or not intend to make specific contributions to support the person....? Of course I intend, he's going to be my husband!

Check the guides and example forms here on VJ. They will help with a lot of your questions.

Bank statements aren't required in most cases. If you do send, then send all of the statement.

Tax transcipts can be obtained free of charge from the IRS.

Send copies (unless and original or certified copy is specifically requested) for submission and give your finace the originals to show in case the CO asks to see an original.

No need for the letter from the ex employer. You are the sponsor. If your income is sufficient no need for anyone else.

Q11 - mark N/A - K1 Visa submission

Where is the job located... in the USA or Mexico? If USA, would he earn over the poverty limit? If so, you may not need to execute an I134 IF he gets an employment letter (at least the Polish embassy web site specifically states they find that sufficient ... you'd have to ask about what the Mexican embassy requirements are.)

Interesting, I never thought of that.... Yes, employer here in USA. Same employer that I work for. He would make over the poverty limit.

US Citizen fiancé/spouse will always have to submit an I-134 as the primary sponsor.

Also - these are US Embassies/Consulates - not Polish/Mexican.

There isn't anything on the I-134 about the beneficiary's income being used. iLove makes sense, you should call the consulate.

Is your fiance currently eligible to work in the US? If so, that will be applicable to the I-864 at AOS. The I-134 is just for the period of time between entry and AOS. The K1 does not allow you to work any more.

OK, nevermind about the letter from employer for my fiance. What about the tax transcripts? I know I can order them, but don't want to wait another month for them to arrive. Can I print anything from Turbo Tax and send that?

You can print copies of your tax returns from Turbo Tax. Be sure to send copies of all 1099's, W-2's, etc. along with all pages of your returns.

Wait a month? I called the IRS line and in 15 mins or so, had them faxed over to me.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yep - it's free - go to the IRS.gov site and do a search for transcripts - they have a 1800 number.

You can get 3 years worth - but depending on when you filed your 2008 returns - they may not have them up and running.

But transcripts are the best thing to send with the affidavits IMO - everything you need is included.
