Is there any chance my uncle can proceed to his application even he already got married? His mom petition him when he was single, (that was 10 years ago) march 2009 when the petition got approved. What he have to do about this....please advice.

A Legal Permanent Resident (LPR - green card holder) cannot petition for a married child. An LPR can only petition for a spouse and unmarried children.

If you uncle got married while his mother was a LPR, the petition for him will be automatically be denied as a LPR cannot petition for a married child.

If his mother became a US citizen prior to his marriage, he is now in the F3 family preference category. Filipinos in the F3 category with I-130s filed on or before June 22, 1991 are now eligible for visas.

Unfortunately lots of people screw up their opportunities to immigrate to the US when they get married without understanding the impact on their immigration petitions.
