Does a joint sponsor have to live in the same household

Hi All

My hubby and I live in NY with our 2 kids. My mom is willing to be a joint sponsor and makes a lot more than the required amount. She has already filled out the 864 however now I have a concern. I dont know if I am reading this wrong but the instructions in the I864 seems to specifically say that a joint sponsor must live in the household. Maybe I am reading this wrong. My mom only lives 1 state away in CT. Could this be a problem?

2/1/2010- AOS , EAD. AP Mailed via USPS priority mail

2/3/2010- Received - via USPS delivery tracking

2/9/2010- Check Cashed

2/9/2010- NOA 1 Received for 131, 765, 485

2/17/2010- Received letter for biometrics

2/19/2010- Completed biometrics via early "walk in'

2/22/2010- Touched on I-765, 48

2/24/2010- Case transferred to CSC

4/2/2010 Card Production Ordered for I-765, AP touched (Yea!!)

4/8/10- Approval notice for I-765 sent via email/ AP touched

4/10/2010 Received AP.

4/12/10 Received EAD-

7/6/10 Contacted USCIS because now Outside normal processing time

7/23/10 Got RFE asking for proof of legitimate marriage- 1page and 1/4 of proofs

8/23/10 sent off RFE response via Expressmail

8/24/10 Received by CSC

9/2/10 Email from USCIS- Card Production Ordered

the joint sponser should be household member but if she lives seperate she can be co-sponser and for this she doesnt have to be household member and she needs to fill I-864 seperately and need to send all the required documents.(see instructions). But whoever is main applicant from you or your husband ,that person has to fill I-864 even though his/her income is zero or not meet the poverty guidelines.I am also filing for my husband who lives with me and i have not enough income i am filling I-864 and my uncle is becoming co-sponser for us and he lives seperate.I called USCIS and asked them this point.

No, the joint sponsor does not need to live in the same household!. They don't even need to live in the same state. Nor do they need to be a relative. It can be family, friend, or co-worker. Just anyone willing and able and a USC.

Dont get confuse in joint sponser or co-sponser.Simple answer is if you are only using your mother's income to meet poverty guidelines not including your income then she needs to fill I-864 seperately and you will fill I-864 seperately.(you both attach your own required documents with your own forms).

But if the principal applicant(you)is using his/her own income and that doesnt meet the poverty guidelines and he/she include someone else(mother) income to meet poverty guidelines then that household member(mother) will fill I-864A and and principal applicant will fillI-864.

WHAT IS I-864A FORM?

Form I-864A, Contract Between Sponsor and HouseholdMember, is an attachment to Form I-864, Affidavit of SupportUnder Section 213A of the Immigration and Nationality Act.It is an optional form, completed and signed by twoindividuals: a sponsor who is completing Form I-864, and ahousehold member who is promising to make his or herincome and/or assets available to the sponsor to help supportthe sponsored immigrant(s). The combined signing of thisform constitutes an agreement that the household member isresponsible along with the sponsor for the support of theindividual(s) named in this form.m his/her household family member then the principal applicant fillI-864 and other member fillI-864A.(its a contract form between principal applicant and household familymember).

Who May Be Considered a "HouseholdMember" for Purposes of This Form?

A relative who has the same principal residence as thesponsor and is related to the sponsor as a spouse, adultchild, parent, or sibling;

A relative or other person whom the sponsor has lawfullyclaimed as a dependent on the sponsor's most recent Federalincome tax return even if that person does not live at thesame residence as the sponsor;

The intending immigrant, in certain circumstances can also be consider as house hold member(see instructions)
