K1 visa approved,but now affidavit of support,worried

Hello to all,this is my first post here and I'm new to the forum so please forgive me if this question has been asked before,I filed for k1 visa in december 2008 for my fiance from iran,well it was approved and I got a packet in the mail a few days ago telling me that her embassy interview is july 6th in abudhabi U.A.E,for the last few years I have been self employed but I have not made enough to be 125% above the federal poverty line(I made under $10,00 this tax year)I have some one who will joint/co-sponsor my fiance,the joint sponsor is pretty well to do and makes much more per year than is required,my question is with the co-sponsor should I still put my self employment earnings in the I-134 affidavit of support?,I'm guessing yes??since this shows that I am employed,should everything be okay since the co-sponsor makes good money?,has anyone been thru or in this same situation?,it's getting down to the wire for us and if I lose my wife I have lost all,your comments and help are extremley appreciated,thanks.

You, as the US Citizen Fiancé must submit an I-134 regardless of earnings status/level - so yes, you'll need to complete the form and provide any/all supporting documents. The co-sponsor will need to complete the same (and provide supporting documents as well).

Many people are in a similar situation and are successful with the process with the aid of a co-sponsor.

OK, first an important point. Your VISA is not approved. You will not apply for a visa, your fiancee (wife) will do that at her interview. You filed a petition and the petition was approved, which allows your fiancee (wife) to apply for a visa. Not to be nit-picky but it makes a difference as now you have to show financial support for your fiancee (wife) in order for the VISA to be approved.

You can get a co-sponsor and you BOTH must submit an affdavit of support. Yes you put your self employment earnings and attach tax returns to verify that. A bank letter is usually useful for self-employed people also. Your co-sponsor will have to do the same.

Ah, just to nit-pick a bit... this is an embassy specific "requirement". Warsaw, for example, specifically states that you (the petitioner) are not required to submit an I-134. They specifically give alternate options. For example, your fiance(e) may provide a letter of employment instead.

01/14/2009 -- she flies to USA, stuck overnight in Frankfurt

01/15/2009 -- she arrives in USA

01/16/2009 -- proposed! she says YES!!! :)

02/14/2009 -- 6 days of bliss in Walt Disney World (6mo given on I94)

02/23/2009 -- sent I129F Next Day Air

02/25/2009 -- NOA1

03/01/2009 -- Touched

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)

You're exactly right.

There's actually no such thing as a 'co-sponsor' anyway with the I134. The instructions for the document don't have such a provision. Some consulates may accept an alternative sponsor via accepting an affidavit from the petitioner and a second affidavit from another party. Some may be only interested in an affidavit from a person with enough income and care less about an affidavit from the petitioner. And some may not want the document at all.

So, therefore (nobody gave this direction), read the embassy=specific instructions on the embassy-specific website. You can find that from the Embassy Info button at the top of the page.

I would have the two forms filled out with the attached income info and send them to your fiance so they can bring them both to the interview and use whatever is needed.

:unsure: Well I just checked the american embassy web page for abudhabi where her interview will be,I'm confused tho,Is the k-1 an immigrant or a non-immigrant visa???,the requirements differ greatly between the two as far as what they require at the time of the interview,it says they want 3 years worth of tax returns from me,I injured my back a few years ago and have not even worked at all for the last 4 years except this year(I have an ebay business)but still I only made under $10,000 this tax year,I have no tax returns other than this year,one thing I found kind of odd is that they require my original passport along with a photo copy of it,WTH????? :wacko: I'm definatley going to have to get on the phone with someone at the embassy,I don't like the idea of mailing my original passport anywere.Concerning the I-134 affidavit,I will fill one out and attach all supporting documents and our other sponsor will fill out the I-134 seperatley with supporting documents attached and both will be submitted???is that how I should go about this?there is nothing that associates my I-134 with the other sponsors I-134 apart from it being for the same person(my wife)?I wonder if all they are concerned with is that at least one of them meets the financial requirement so so uncle sam can get his money if need be.

K-1 is considered a Non-immigrant visa. You have to get married to the petitioner before you can AOS.

You shouldn't have to send your passport to them - do you have the link?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

abudhabi requirements for non-immigrant visa from their website

A passport valid for at least 6 months from the planned date of entry into the United States.

A copy of the passport -- the picture page and any amendments.

Fully completed and signed application forms. The forms must be signed by the applicant and, if prepared by someone else, the preparer. Everyone must bring an Electronic Visa Application Form DS 156.

Applicants above 16 also need to bring form DS 157.

One photograph that meets application guidelines.

A receipt of payment for the non-refundable application fee of 484.70 dirhams per applicant from an accepting branch of the National Bank of Abu Dhabi.

Supporting Documents: For the issuance of most types of non-immigrant visas,

United States law requires that the applicant maintains a residence outside of the United States, and demonstrate sufficiently strong family, social and economic ties to that place of residence, i.e. the United Arab Emirates. You should be prepared to present evidence of your ties, if requested. Such ties may include proof of employment, proof of ownership of a business or property, and a bank statement. Please provide original documents and English translations. However, presentation of such documents will not ensure the issuance of a visa. Approval of a visa application is ultimately determined by a consular officer at the time of the interview.

According to this there is no mention of an I-134,but.........I recieved a packet from the embassy a few days ago and it contains the I-134 and medical exam forms and ds-230,ds-156,ds-157,I'm wondering if they sent this to me for when we(she) apply's for AOS??,

While the I-134 is not required by USCIS it is used by many embassies. Most will apply the I-864 requirements to the I-134. The 864 is the affidavit of support that is used for AOS.

K1 is non-immigrant. You put up the link to the requirements for immigrant visa. Your original passport is not required.

Actually, no one is required to provide an I-134, unless a consulate spefically requires it. It is a convenience form and is universally accepted. You are required to establish your fiancee/spouse/family will not be a public charge, you can do this in a number of ways, with a nuber of documents. The I-134 is a suggested format and most people use it.

:thumbs: Well after going thru earnings records correctly(versus guessing)it looks like I made more than the 125% required :bonk: all my worrying has been for nothing as far as the I-134 goes,all this stuff stresses me out so bad I can't half think most of the time,I'm always one to expect the worst,I wish I wasn't such a pecimist :bonk:

Good news on the 125%. Another thing you can check off on the "to do" list. It can be a frustrating process. But when you are together after obtaining the visa it is worth all the stress. :)
