This is the very first time I interact here in Visa Journey. This is the time I really need help from those who will try to understand my situation. i have an Interview on May 28th , and I guess I need an advise to prevent a denial from the US Embassy.

Last october My Craig and I lodged the application. I know I am still single... so I ticked the Box where it says i am single, coz that is what I know. I was asked to get a copy of my CENOMAR.. Certificate of No Marriage.. I was so confident about my status and I was shocked in disbelief that my marriage last 2000 was validated . Which I never had any contact with the person i married way back then. The Japanese National , which I only met and got married and he never returned back to my country, I went to the immigration here in the Philippines to prove that there are no other history of travel after he last visited. I never had any documents in my hand for 9 long years. Coz what I know, it was never been validated and it is considered as void from the very beggining.

Now, my problem is.. I just found out recently that i am married. My fiance loves me so much that he is willing to help me get out through this. It cause so much burden for both of us.. because we wanted to be together. I have nothing to offer him here in my country.. his life evolves in the US.. his living ,kids and his Job.. so either one of us needs to give way..

So we both decided to go for an annulment which is the best thing we should do right now to correct the mistake. What i want to know is.. Will this drama of annulment won't affect our application? Or is there any other way to clean this mess up before my interview date..

Please if anyone who have the kind heart to share what they know.. I will highly appreciate it.. Thank you!

for sure..your annulment won't be done before your interview...it would take several years the most..sorry. had mine for 4 years plus. a lot of time, effort..patience..and money to see it through. you said. u had no news from your first husband for over 9 years? maybe u could seek advice on that in mind. marriage was not consummated or declaring him dead..7 years of not knowing where your husband, is a cause to declare him dead. seek an answer that is shorter in time..than annulment.

Yes it will affect your application, as it will be denied, since you need to be free to marry prior to filing the K-1, and now your up to the visa application part.

You will have to be divorced, and you will most likely have to re-do everything again - starting with the K-1.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Find a good lawyer.. You could file an annulment based on abandonment..

If there is abandonment and you have not heard from the spouse for more than two years or fours years (under different circumstances) and there is good reason to believe that the spouse is dead, then, one can file a petition for presumptive death for purposes of remarriage.

What made you think that you're single where in fact you said you got married in 2000?The mere fact that you faced the priest or the judge and declared you as man and wife,from that day on,you're already married.Anyway,you might want to postpone your interview and proceed in filing an annulment.Search for good lawyers that could speed up the process for 6-8mos but be prepared for the cost because they ask for high fees.You might have a hard time on your interview because you filed while your first marriage exists but you might get away from it,i guess.
