Hello Everybody,

My question is this. My fiance has obtained her K1 Visa and will become my wife on Jun. 6th of 2009. My question is this, is there some type of paperwork we will need to complete so that there will be no problems with my new wife crossing over from the American boarder to the Canadian boarder and then returning back from the Canadian boarder to the US? We want to to have our Honeymoon on the Canadian side of the Falls because I was unable to book a hotel on the US side with a view of the Niagara Falls?

I wouldn't risk this!

There are accounts on VJ of people who have done what you are suggesting - i.e. cross the US/Canadian border before getting their AP, and then successfully re-enter the US. I think most of those stories were from a few years ago when presenting a passport at US border entry from Canada was not mandatory for US citizens.

I think this is a very bad idea. You can be denied entry to the US, and now you're stuck in Canada with no permanent legal status in either country (assuming your wife is not Canadian). The upside: you get a hotel room with a view. The downside: You're stuck outside the US and unable to re-enter, have thrown away all the time and money of your K1 filing, and are now forced to begin an entirely new CR1 or K3 petition, while your wife returns to her home country to wait it out. Pretty obvious decision, I think.

Book a hotel in New York state. Bring some binoculars to see the Falls from the American side.

Depending on where your fiancee is from, Canada may NOT allow entry without a visa, and if did enter Canada, the USA WILL NOT ALLOW re-entry because a K-1 is a SINGLE ENTRY VISA!

There are plenty of places within the USA that you can Honeymoon.

Bellagio in Las Vegas has a great fountain - get a room with the view of the fountain - its great! And yes you can even get married in Vegas (they even have a drive thru chapel). And leave your money for the casinos - they need it. Have Fun

I'm having my ceremony (religious) here in Brazil before my legal marriage in America. So we are going for our honeymoon after the ceremony, while still not even being legally married. So if this isn't something that bothers you, you two could have your honeymoon BEFORE she enters the US. Just a thought.

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

06-08-2010: Case transferred to CSC

Don't mention anything about this when you come to the US POE - they might get confused :)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
