My step-daughter is 16 years old. What is the fastest way to bring her to the USA? Her natural father died yesterday. Can I go directly to the embassy in Ukraine and process the application? (My wife and I reside in the USA)

Thank you,

Robert

Please ignore the time line. My step daughter in this thread has never been to the USA. (Her sister is here with mom). We have not started any paperwork yet for my step-daughter in Ukraine. As I said we just found out that her natural father died. We want her to join us in the US. I know that I can start a I-30 but I was wondering if there is a faster way. (since she is a minor with no parents helping her)

So far I found that I can process a IR Visa through the I-130. I wonder if there is a quicker way... How long does the IR process take?

Contact the embassy, they can help. I have a friend who's ex wife was killed in a road accident and his 2 children were left alone, the embassy were able to get a advanced parole entry papers for the children so they could go to the US with their father and process the paperwork from there.

I dont know all the details but I do know that the children arrived with their father 3 weeks later.

Thoughts are with you at this difficult time.

Good Luck

Depending on service center, the IR could take 6mos to a year.... you can contact the embassy in Kiev, but I am not aware of an alternate solution

YMMV

A. If you are outside the United States and need to visit the United States temporarily for emergent humanitarian reasons:

1. You may apply for an advance parole document. However, your application must be based on the fact that you cannot obtain the necessary visa and any required waiver of inadmissibility. Parole under these conditions is granted on a case-by-case basis for temporary entry, according to such conditions as prescribed.

2. A person in the United States may file this application on your behalf. In so doing, he or she should complete Part 1 of the form with information about him or herself.

the caveat would be the I-131 is for temporary visit... the OP needs a permanant solution... but by all means, exhaust this avenue as a potential solution...

YMMV

I called my friend and that is the way his 2 children came to the US. They then filed for AOS once here and now have their 10 year greencards.
