Hello you all,

i am new here and been reading so many threads but still could not finde any information on my case. My brother who is about to get his second divorce has a daugher who was living with him out of his first marriage. Since he and his ex-wife are still best of friends and very close he let my niece go see her mom who lives in the states on regular bases. My ex-sister in law moved there more than a year ago and is not a citizen of the united sates. So last x-mas my niece went to see her mom again but she did not return. Since my brother is going trou a very ruff time with his divorce he thought it was better for my niece to stay with her mom. As my brother tould me now she went on a VW and my ex-sister in law has still not filed for any Visa, AOS or what ever she need to file for. And the biggest problem is that she or her current husband don´t even know what they really need to do.

Now my question is, does anybody have advise for us? Please help!!!!

The daughter (your niece) is very likely in overstay status - how old is she?

She just turned 11 today. And i have the fear that she could be send back and will not be alowed to visit her mom for years. After all they are very close.

08/18/2010 My son's check was cashed

09/27/2010 Biometrics appointment

10/26/2010 APPROVED

11/1/2010 10yrs GC in the mail

Thank you, i sure hope so cause my brother (actually he is my stepbrother) dont have any family but me. And yes my little Baby girl need her mom.
