hey everyoe I have to tell you about the vermont service center and what they did. I called my congressman for help and they called me yesterday and when I got the news it was horrible omg you just dont know well let me say immagration said to the congressman that they sent me aletter to send them more info that they needed and this was so wrong let me tell you why. in August they asked me and they told me I could fax it back or write well I faxed it cos it was faster and I did call up immagration to make sure they got it but never responded so I assumed they got it cos they never said they did not and they never sent me something else saying they needed it again so we have jsut been waiting cos if that was the case i would have sent it in again and this time i would have mailed it in just cos i would have been affraid that the fax was not working for some reason you know well now we have to refile again and wait all over so for anyone who ever gets something to send in please please just mail it and make sure it is over nite or that they have to sign for it omg dont take that chance like i did and I am so sorry i ever faxed it in. we are going crazy it felt like i died just hearing this from the congressmans office omg you just dont know, but now i will refile and hopefully we wont wait long cos they had the file on hold i just wanted everyone to know and to be careful what you do with these people cos they dont tell you anything alot of the times and then you are stuck. just pray for me and my fiance we are holding on with our love and this is hard to be away they are keeping us away for a few pieces of paper they needed but did not let me know i needed to resend so now we have to refile Marie

I am sorry this has happened to you. Unfortunately, I hear horror stories about how USCIS and the Embassies jack people around with their screw-ups. They have no idea nor do they care at what extent they ruin people's lives and sincere plans. I am very bitter about this process !

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Marie, never assume! I'm sorry that this happened to you. I sure hope things work the second time around. It's a minor set back but just have the strength and patience to continue. Good Luck :star:

So the letter that you got recently meant they were reveiwing(researching) your case... not that it was in review by an officer. At least you have an answer and can proceed now.

Im so sorry that you lost your time, that isnt replacable. (F)

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

If you are not married you file for the K1 if you are married you first file the I130 for a CR1/IR1 and then when you recieve the notice of action (NOA1) from the I130 filing, you can file for the K3, which is applied for using the same application used as for the K1 (I129F). The K3 is a non immigrant visa used to get the spouse here sooner so they can wait for processing of the CR1 in the U.S., however, lately it has been that both K3 and I130's have been approved together.

Yes, echoing what childress has said.

The I-129f is also used to file for the K3, when filed in connection to an underlying I-130(spousal petition). when the K3 was developed, they just decided to use the already present I-129f for both purposes.

So, we only filed for the K3, although two petitions are required.

the fiance visa was a non immigrant visa which used to be processed much faster, so they allowed it to be linked to the spouse immigrant visa as a way to allow married people to be processed as fast as unmarried people. like a reward for being married.

But now the two visas do not have such a difference in time for processing.

Best of luck with your second attempt. Maybe you can apply for expedition for the whole earlier experience, and I've heard you might want to apply for that more than once before they allow it.

Processing Estimates/Stats : Your I-130 was approved in 101 days from your NOA1 date. NVC completed in 26 days! Interview was 201 days from Noa 1.
